This morning I was checking Facebook and came across a posting from a friend that included a link to a blog by a freelance writer for the New York Times, Viv Bernstein. The topic was of interest, so I opened the article. To my surprise, the lead photo was mine! I was totally stunned!! Good stunned. No, I didn't get paid for its use (it was taken at a Chicagoland Speedway event where the DW and I were the photographers), but did receive photo credit and a link back to my Flickr page, so I was happy. Since my return to more serious photography 7 years ago, I am still amazed whenever one of my photos is used. I hope I never get over that amazement and continue to try to improve thanks to the people who inhabit websites like this. Just a quick thanks to all for your help and encouragement.

Congrats Terry on having your photo used. Whats not cool is permission was not asked and you were not paid. I see they did give you credit at the bottom but i dont think that enough.

I have discussed this at length with my daughter, who was a magazine editor. Because of all the free photos on the internet, it can be a very murky area. On my flickr page, I have the photos licensed for Attribution. So everyone did exactly as they were required. I was paid for covering the event by the Speedway, so I really have no complaints. Many times I cover events where I am not allowed to sell the images because of agreements with the promoters, ie, Nascar, NHRA (national events), etc. I have an agreement with my Speedway that for all the local racers, I will provide a digital copy for free, but if anyone wants hard copies that I have to process, then I get to charge to recoup my time and materials.

Just to clarify, it is my understanding that if you make photos available on these web sites, you are granting permission for the photo to be used without compensation.

The only requirement to use the photo was to provide a credit, which I was happy to do.

For what it's worth, my blog does not generate real income so I didn't make any money off of the use of your photo. But a lot of people did see your work, if that's any consolation.

In this instance, since the photographer explicitly posted that the photo is free to be used with attribution being the only requirement, then Viv did nothing wrong. However, Viv's understanding that that any photo posted on Flickr or any other photo sharing site can be used without permission or compensation is completely wrong. It doesn't matter that the blog post isn't generating money directly for the writer (although there is an ad at the bottom of the page).

Viv, for my photos, that is exactly my interpretation. I sent you a message on your blog, but I wasn't sure it went through, thanking you for using the image. Since I was already paid for covering the event by my Speedway, their was no concern or expectation on my part for any further compensation! I am happy that it fit your needs. In the future, if you find another need to peruse my photos feel free. As you did, all I ask is the attribution. And just so everyone knows, I want to repeat, I'm not giving away the photos because I was already paid and my employer has everyone of them to use in any way they want. They allow me to post them on Flickr and have no expectation of privacy. Thank you everyone!!

Viv, if you ever get to the Chicagoland Speedway, please look me up. During the Nascar and major Speedway events , I manage the Media Center Desk, otherwise I am a staff photographer for both the Speedway and Route 66 Raceway.

I didn't see your message -- sorry about that. Maybe a glitch somewhere.

And yes, not all photos on Flickr are free. I understand that. Because my blog is new and doesn't generate real income, I do seek out free photos to augment my posts. I hope in the future I will be able to pay for photos.

I would love to visit to Chicagoland, but I am based in Charlotte, NC and don't get to travel to every track. That's one I haven't been to yet. If I do get there I will make sure to look you up!
