So what Travis wrote is lying, but the other person is telling the truth.

No, she is trying not to admit that she really has no idea if Travis was abusive or not. Bottom line is JM is trying to make the point and she is not answering directly.

She is speculating that he was abusive due to her continuum. Of course now that piece of evidence is no longer a big deal now that she is on cross.

The IM and texts speak for themselves despite any framing by any witness, so let the jury decide if indeed a BWS defense applies here, god knows they've had enough training by now.

Thanks for those updates.

I can see your point with JM from time to time, but not all the time. You seem to have an insider's mind on how the court system works and how DT and prosecutors work. Most of us don't have that advantage, nor does the jury (I'd assume), so I can see how there would be different perspectives.

I also realize that some things that JM asks of ALV aren't black and white and may need a bit more explaining, but there are very, very few things that she won't answer directly when it would be that simple. She lost me with her smug attitude on first day of cross. I'd think she would want to come across as a likeable person, one who cooperates because that is more likely to get the people to listen and actually hear your words.

I guess my point is it only takes one juror to declare a hung jury or force a 2nd degree conviction, Martinez needs to focus, he's allowing himself to get caught up in these power plays, soooo unnecessary.

It just seems to me that ALV cannot answer a straight question.

15 minutes on whether or not she was a 'keynote speaker' should have been a quick NO. Not the way ALV is answering all JM questions.

There are definitely questions that can be answered "yes" or "no". If she's testified in court before, she KNOWS the DT gets another shot at her where she can expand on it. Now, she just looks defensive.

But he is right about not being able to 'see' non verbal communication if you are just reading the written word.

How many times have you sent someone a text or email and they have not really "gotten" what you meant but something you really didn't MEAN?

I sent my sister (in AZ ironically) an email about her need to get mom's furniture that we're storing, and that she wants, out of the storage unit, and she shot back this nasty email about my attitude and the "tone" of my email that blew my mind, and other people I showed both to. Haven't spoken to her since.

I'm watching the other trial, the one where the State is throwing everything at the wall to see if anything will stick.

Oh because ALV is not sidestepping every question JM askes her right? JM is not being super aggressive today either so don't have that as an excuse, ALV is being difficult and trying to sidestep questions.

JM is making great points about how she never even talk to travis or the other girl, but based on Selected Texts (selected by the DT) alone (which she says is only 10% on a conversation) she made an opinion of both of them, which is ridiculous.

Seriously I know you don't like JM, but you can at least give the man his due, he is doing a great job destroying her testimony's credibility.
