Damage liability: member or renter?

Hi,

We're looking at a scenario a year down the road where it will make more sense for us to rent our points than to do an exchange. If we as members rent out our points and the renter causes room damage during their stay, who assumes liability: the member or the renter? I've never seen this addressed before.

The member. One of the draw backs to renting. If you rent to a "SLOB" you could end up paying more than your rental fee. Be careful to whom you rent.
 
One thing to keep in mind BrianBWV is if the damage is extenive it is considered criminal damage and the person staying in the room can be charged criminally. Otherwise the constant slob is nothing new. Just remind your renters that you expect no negative reports.

Thank you so much for the quick feedback. You definitely rasied points I hadn't considered. From a peace of mind standpoint, I'm beginning to wonder if it might not make more sense to transfer points to an existing member rather than to go with a non-member.
 

The renter will have to register to check into the room and provide address, phone number and credit card (or cash) for incidental expenses.

If, for some reason, the renter does not provide a credit card (it is not required) and Disney is unable to get satisfaction from the renter for any damages incurred, they would likely have recourse with the member who reserved for them.

While it's not a scenario that is likely to happen, it is a possibility.

Perhaps it would be worthwhile to consult with an attorney to have a rental agreement drafted to cover this among other things.

Though I obviously have no way of knowiung (or enforcing) I make a credit card at checkin part of my rental agreement.
