Nova Scotia/PEI/New Brunswick ABD pre-trip thread and questions.

Ugh. What a stressful night you must've had.

You should be eligible for compensation by filing with AC (mechanical issues are deemed within their control, alas AC loves to deny claims, which you can and should fight if they do).

When Lufthansa cancelled my flight to Edinburgh in March I filed for compensation and (eventually, after prodding them several times and filing a claim with their regulatory body, then having to follow-up, but I digress) received 750 Euros. Other than the stress and 2 very tight connections (in Heathrow and Frankfurt) it worked out and I got an extra night in Edinburgh. I only had a few hours notice of the cancellation and I had to get myself to the airport in a matter of hours (was supposed to fly the next day -- good thing I'm always packed a day in advance).

I'm looking to your trip report! Safe travels :)
So I filed with Air Canada for compensation, and they did, in fact, deny the claim. This is what they said:

We've reviewed your booking and we’ve confirmed that the root cause and the most significant contributing factor of your delay was due to
This flight was delayed due to unforeseen maintenance that does not include scheduled maintenance or mechanical problems identified during scheduled maintenance.

In accordance with the Air Passenger Protection Regulations, a delay caused by
This flight was delayed due to unforeseen maintenance that does not include scheduled maintenance or mechanical problems identified during scheduled maintenance.
is determined to be within our control but required for safety-related reasons and you are not eligible to receive any compensation.
So I'm curious what kinds of things you did to fight the decision. At the very LEAST they owe me the $40 that United charged me for my checked bag, because the first checked bag was included free with my Air Canada fare.

You can file a claim with the CTA. They (the CTA) are notoriously slow to respond, but with a mechanical delay AC does owe you a duty of care. I have filed with the CTA before for a WJ flight and did get my money back. I find AC is usually pretty fair, but needs to be prodded along the way.

Have you e-mailed their customer service (also notoriously slow to respond)? That's how I got back the difference in points between my first class flight (booked) and biz class seat (what I flew) due to the snow bomb cyclone in Chicago in February (I couldn't get to Chicago to make my connection). Mind you I had to follow-up several times ad make quite a few phone calls, but within 4.5 months I had the points back in my account.

Do you think I should I try AC's customer service first or the CTA or both at the same time?

Thanks!

Read through "Refused Compensation, You are Entitled to an Explanation". There is a section at the bottom of the page that details what info to ask AC for WRT to "unforeseen maintenance". AC is famous for exploiting one of the major loopholes provided to passengers under APPR. Get the info from them and see if it falls in line with a stated reason for compensation.

I have read there are also FB groups for AC denied compensation claims.

Yikes! It's a good thing these trips are done for the year, because I just heard the ferry to Prince Edward Island won't be running for the next 3 weeks! Apparently there's only 2 ferries, and one was already out of service, being repaired due to hitting the dock in Nova Scotia, and the other one that was still running is now having engine issues. I mean, you can still get to PEI via the bridge from New Brunswick, but it might require some re-working of that travel day at the very least. Not the end of the world, but I really did enjoy that ferry ride, and the time at the Wood Islands Lighthouse.

P.S. I plan on starting my Trip Report SOON!!!
