New oven - broiler goes on during bake cycle

We purchased a GE Profile gas range in February.

Recently I was baking cookies, using parchment paper and on my 3rd batch of cookies I came in to find the cookies and the parchment paper burnt. GE is trying to tell me the broiler goes on to maintain the temperature in the oven. That would be fine but the broiler is causing the food to burn - which shouldn't be happening.

Anyone have this range and have this problem?

I have had them in for service 3 times already.
 
Does your state have a general Lemon Law? Three tries, it sounds like it's time for GE to replace it. Have you tried talking to the store manager where you bought it?
 
We have a Maytag w/convection. The only time both the Broiler element and Oven element come on is when it is we use "Convection Roast". When we set it to "Convection Bake" the Lower element and convection come on, with traditional "Bake" only the lower element.
