Need to vent!

I have no idea what I would have done....probably gone over and had a few words with the old lady!!!!
 
I would definatly take some kind of legal action. It is destruction of property. I'd talk to a lawyer and / or cop before your neighbor though.
 
I hate to tell you this but if they took that much off it isn't going to recover. We had maples in Ohio and every once in a while the utilities co. sould come out and "top" the trees. I understand why they had to do it, but over the course of 5 years every single maple on the curb died. I think the rule of thumb is not more than 20%. If the tree does die (it may take a year or 2) it be weaker and one good storm will send it into your house or the neighbors. Good luck-I would be sooooo ticked

We had a similar situation years ago. I was upstairs unpacking, we had moved in a week or so before, and I heard chainsaws. I didn't think anything of it either, my focus was getting things put away. That evening I went out back and we had 2 trees missing! They weren't huge but they were the only trees we had.

Asked the neighbors to the left and right of us and they had been at work all day and hadn't seen or heard anything.

A couple days go by and we found out that the lady who lives to the left and behind us - we have just over an acre of pie shaped land, with nobody directly behind us - asked her friend who works for the city to take our trees down because to her they looked like they were a hazard.

They never verified who owned the land before they started cutting. The guy assumed they were hers because she asked.

I wish now I would have pursued it but being the new family in the neighborhood I didn't want to make enemies.

Exactly!

Many people don't realize that there is a right way and a wrong way to trim a tree. These "crews" that do these "hatrack jobs" have no idea what they're doing. Just because you know how to turn on a chainsaw doesn't mean that you know how to properly trim a tree. My neighbor has hatracked an oak in his front yard. You should see this "tree", half of it is yellow (sick or dying) and the tree is leaning to the right. The next hurricane to come our way should take care of it once and for all.:sad2: My neighbor brags about how much money he has saved whenever he "trims" the oak. :rolleyes:
 
That's the thing too....thanks for bringing that up Belle.....My kids play with her grandkids. A little background info here

We have lived in our house for years. When we moved in we were poor and had 1 child and another on the way. The husband who lived next door was a HUGE help to us in doing whatever he could with manual labor to get us in our home. He was like my own grandfather. He gave our kids money for their birthdays. Generally great guy who we all loved and adored. His son and DIL and their kids live behind them. About 6 years ago another dd and son in law bought their house *it was falling apart* and moved them out, tore down the existing house and made a brand new nice one and moved them back in. Not too long after that the husband passed away. The son in law wanted to take down 2 of our trees when they were re-building the house but we told him no way. Finally they get moved in, the fence gets fixed and all has been great!

Today this happens. I am at a loss because I honestly believe it was the son in law who just did it. I really do NOT think the lovely old woman next door would do anything like that. She is almost 90 and we see her occasionally when she is waiting for a ride to the doctor or something. I could have gone over splitting mad at her but honestly I don't think she did it. I really don't want to make waves with the neighbors, her family and others that my kids and I have dealings with and yet I'm so mad.

I do have a call into the police department to find out what can be done but even they said pretty much all they can do is put it on file and then if something else happens with stuff like this go from there.

I am thinking now after settling down a little and looking at it from outside I think they cut too much to save it. I'm not 100 percent certain that we wouldn't have had to cut it down soon anyway but I'm mad the decision wasn't made by me.

TY....I'm so mad and yet there isn't much I can do about it now. I think we'll end up having it permanently removed this year because the butcher job is just too bad!

Double check your deed. And their deed is PUBLIC RECORD either online at your county registry site or at your local town hall assessor's office. You can make doubly sure that the tree was on your property by reviewing the deeds.
Where are your (iron) pins? It may be noted on your deed as well as your neighbor's deed. And if there is a plot plan it will be noted as "IP" on the plan.

My DH is a Registered Professional Land Surveyor in many states here in NE. He sees this all the time.

ALSO, put on your "thinking cap" and try to remember the name of the company that was there cutting the tree down. Did anyone else in the neighborhood notice the truck and its name on the truck?

I am really surprised that the tree company came out and cut down a tree on a property line w/o the consent of both neighbors even though only ONE is paying the bill. This just saves a whole of aggravation in the end...(like now).

Document everything and take pictures. Will the tree need replacing or will it grow back.
 
Similar thing happened next door except the tree cutters cut the tree wrong and it fell on the neighbor's house! It was a horrible experience for my neighbor.
 
Knowing how they work they work for cash only. They had no name on their truck and it was just 2 men out there. Ugh!

As you can see she said there was no name on the truck.
 
Update...sorry had a dance recital to go to

The cops came, took the pics before and after my statement. They talked to my neighbor *90 year old lovely woman* who confirmed it was her son in law who hired said "cutters".

We tried to call Son In Law who won't talk to us. The cute lady next door called and he admitted to her he didn't know the name of the company. It was just as I thought. They were no name people looking for cash only with no company affiliation and no ties to him at all. They did NOT give him an invoice and he paid them $125.00 in cash. He claims he only hired them to take care of the tree on THEIR side of the property but even the cops claimed they killed and they went too far on our side. I have a report on file and if anything else happens I can file a report but for now I have nothing.

I will post a pic of the newly butchered tree tomorrow. I am pissed beyond belief but believe it is the SON IN LAW who did this and not my neighbor who I still adore!

Our house is behind our garage which is the front of the property and so except for the chainsaw noise I wouldn't have known anyway until it was too late. I have a report against the son in law but I can't go any further legally with it for now.

SMALL CLAIMS COURT.

Have a tree specialist come out and evaluate the existing tree...does it need to come down as it has been destroyed, can it be reshaped, will it grow back with no issues. Are there existing clean up issues? What do they feel is the value on the tree before it was chopped up? Get a few estimates.

Sue the SIL in SMC for the damages to your property. For replacement of the tree, for the clean up you will need to do that the tree cutters left in your yard.

OP, what if you were not home and stopped these people from further damage you would be getting estimates for a brand new tree. This is out and out brazen behavior. To just select some unknown company to come on YOUR property and cut down a tree and pay them cash...:mad: The reason the SIL will not talk to you is because he knows he has done some serious damage here.

I would not just walk away from this. Simple procedure to get some estimates, gather up your before and after pictures. Send the SIL a bill certified mail, if he does not respond in a timely manner, it is off to SMC you go with all your paperwork.:thumbsup2

Yes, it definitely sounds like he was behind it and knows exactly what he did. If what he said is true about the crew mistakenly trimming your tree instead of theirs, then why not speak to you? If I hired someone to do work on my property and later learned that the work was done on my neighbor's property, I would be mortified. I would then apologize to my neighbors profusely and find a way to make things right and to their satisfaction. :sad2: :sad2:

I saw an episode of Texas Justice like that where the psycho tree killing neighbour had to pay for having this lady's tree butchered..I think she got over 2Gs. I would take pics of the tree, file a police report and call court tv so fast their head would spin..

And apparently I need to learn to type faster and not stop in the middle of typing to get on my kids LOL
