I am not one who typically is a pest, but with having shelled out over $15K I am anxiously awaiting to hear that the paperwork has been sent off to the county clerks office and ill see my points soon.

My paperwork and check was sent out on 5/15 and received on 5/20. I did reach out to the closing company last Wednesday 5/22 and was told the sellers had an appointment with the notary. So here we are another week later and I haven't heard anything. Would I be too much of a pain to email again for an update?

We are working with Attorney Sweets office, if anyone has experiences with them or their typical communication. So far when I send and email they are pretty responsive. I just don't want to be that annoying buyer.

I guess I am wondering if I am being too much of a pest if I send another email looking for an update a week later. I'm trying to be patient.

FYI our closing isn't set until 6/7, so i guess the sellers have another week to get their paperwork back. but my guess is the sooner they get it back, the sooner they get their money and the sooner they can pay off that mortgage on the contract.

I can tell you as a seller that I have been emailing my closing agent once a week to find out status. My closing date is not scheduled until July 3rd. however I would like my proceeds as soon as possible. The buyer claimed that they were going to their bank yesterday and sending documents back this week. If I do not have any update on Friday, I will email the closing agent again to inquire about status.

As I will be leaving on vacation at the end of June, my wish is to have my proceeds in my hands before I leave.

I never asked anyone about any updates, but I bought my points months before I had any plans to use them, so it really didn't matter to me when it got done. That being said though, my transaction was super fast though. 35 days from offer to close.

I would always recommend shooting an email to your associate or calling your associate. Your associate is typically better at getting answers from the buyer and/or seller. For example, I love emails such as "Good morning Jason, I just sent in my final documents and funds. If you could please find out when the seller plans on sending in their final documents for me."

We try our best at The Timeshare Store, Inc.® to get info from both parties so we can pass it on to the other party. I hope you found out the status soon on your transaction.

We used the same title company as you for both of our resales. I never contacted them . They emailed me when they received my documents and then emailed me again when we closed. I didn't have any contact in between.

You are paying them so you might as well be informed and know the timetable. If you have a question send a email or even call if you don't hear back in a timely manner. I have had my closing agent leave the company and it was "reassigned". It took a call and some questioning to figure it out, but then the new person looked for it and found it and said they would get to it on this time frame.

I thought that they were very communicative and very helpful, particularly in getting out the proceeds.

I had one closing agent who told me that they didn't send out proceeds until Disney had released the points into the buyers account- which is typically 3-4 weeks after closing. I used the same agent you are for another sale and they sent out the check the day after closing. The right closing agent does matter.

Really never except on one sale that was taking a very long time.

This is my 2nd resale contract. I was in the dark for my first one in January 2018. For this purchase, the title company has a website where I can see the status... like when stuff was sent and returned (they got my estoppel the same day as ROFR). I love being able to pop over there and see that today the seller confirmed receipt of the documents and will mail them out Friday.

Maybe the holiday weekend has delayed everything.

If I haven't touched base or heard anything in a week, I check in no matter what. If that's annoying then so be it. You never know when you might have missed something or the next phase of paperwork was sent by someone different than your usual contact and it got sent to your junk mail.

Exactly. Please buyers and sellers never hesitate to contact your associate at The Timeshare Store, Inc.® for updates.

I keep waiting for you all to have a contract I like. You guys are so nice! Probably once this one gets taken in ROFR... lol - maybe I'll find one from you. So far haven't though!

I recently experienced a very similar concern that you have. I apologize for a lengthy post, but would like to share our experiences. Our timeline is the following:

5/7: closing documents received
5/8: mailed casher’s check & closing documents via Fedex
5/9: closing documents received by the title company
5/15: 1st contact to the title company for any update & was told that they were waiting on the closing documents from the seller. They contacted the seller on be half.
5/18: 2nd contact to the title company for any update about the seller
5/21: 1st contact to the resale agent, but no reply
5/23: the title company replied about the seller, “they are working on sending out their closing documents. They are selling two contracts and were waiting for the closing documents on the second property.”
5/28: 3rd contact to the title company requesting for the time line. For the first time, we heard that the seller actually had until 6/24 to return their documents! This really put me on the edge :furious: and made us feel that the sellers were sitting on our contract for simultaneous closures for their convenience. I started to re-think about the contract and requested if there is any possibility to walk away.

I cc’d the resale agent on this email and suddenly heard from her, “What am I missing here? (The title company) copied me on your correspondence, I don't have any emails from you, your email to her it implies that you were not hearing back from me.”

Forwarded the previous email to the resale agent from 5/21

5/29: received the lengthy email from the resale agent. The resale agent still didn’t receive the forwarded email- which is okay at this point. Lost emails in junk mails happen all the time.

The lengthy emailed emphasized:
  1. This contract took longer for ROFR to be waived by Disney compared to the 2nd contract which was returned to the title company on the same day. (FYI: that contract closed on a next day after the title company received the check & our documents, and the points already being posted into my DVC account (I already had a DVC account set up from the direct contract before)
  2. Was told that it was “EXTREMELY rare, and not at all typical” for the 2nd contract to be closed in 30 days
  3. “no one has done anything wrong at this point. “
My reply to the resale agent regarding these points were:

  1. The differences between 2 contracts for Disney to wave ROFR was only 5 days
  2. Based on following posts from the DIS board forum’s closing posts for last 2-3 months, a seller taking more than 2.5 weeks is longer than an average for a domestic seller without a legitimate reason (e.g. family emergency, illness, traveling etc.)
Then, we received a disappointing email saying that our expectations were unrealistic, and there was an option to walk away from the contract losing our deposit. But, what really bothered us was the resale agent said they could “resell this contract within 10 mins.” Yes, it is a small contract which is extremely high in demand, but we felt so small not mattering to the resale agent much :sad1:.

We did hear an update about the seller’s situation from the resale agent on the same day. They had to send back a closing document to a title company due to spelling errors and received it on 5/23. Away for a long weekend, and all documents were sent back 5/29.

A title company never mentioned anything about misspelled document and had to re-issue a new one until recently. And, per the resale agent, it was the 1st time hearing back from the seller about it and traveling for a long weekend.

I completely understood about the reasons for a delay, and everything was back on track. However, we were truly disappointed about how communications went and unprofessional responses from the resale agent. We are not sure if involving two parties, a title company and a resale agent, have sped up the whole process.

I just closed on a resale and got my new DVC member number last week.

Every party in my transaction (sales agent and closing company) provided a description and estimated timeline along the way. Usually, those timelines were “up to four weeks”. Given that, I’d personally feel like a turd ‘following up’ after only a week.

Fortunately for me, every step actually took two weeks and I never had to follow up.

In regards to the post just above me, my big fear was the seller’s response time. We were all subject to how quickly they got things done. Fortunately, they signed and return papers immediately. However, you can just as easily get someone who only checks their email weekly and then procrastinates on top of that. In that case, there is also only so much the intermediaries can do too.

What reason would a seller have to wait until the closing date to sign and return closing documents. I was very quick to fill out all paperwork througout the process. They have until later this month to close. Its been two weeks since I returned all the necessary funds and paperwork.

The seller needs to find a notary to witness and stamp the documents which can take time.

I'm not sure if the seller is 1 or more people, but if it's multiple they may not live together causing increased time. Our first contract was a couple that were divorcing and our contract had to go from one to another. Call your broker to inquire why it's taking so long, they should be able to get answers and help you move along.
