WWYD? Neighbor smoking weed

the laws are written differently in each state w/legalized (med or recreational or both). in my state there could be a violation for the circumstance the op is speaking to-

Smoking weed is within the law if you are on private property, outside the view (or smell) of the general public (so if the smoker is in an open garage where he's seen or the weed is smelled by someone else not on his property-it's illegal) with a civil penalty/$100 fine for each instance. THAT SAID-the homeowner in this situation, if put on notice by the offended neighbor would be at much greater risk than the smoker if the owner permits it to continue. this would constitute maintaining a structure (garage) that is being used to engage in said illegal act (smoking w/in the view or smell of the public) which is a felony and has an initial $1000 fine but can carry up to 5 years incarceration and $10,000 in fines.

this is why the 'bud and breakfast' lodgings in our neck of the woods strictly limit exactly where on their properties people can partake.

i don't know how ardently my state is prosecuting but those are the laws on the books.

That's interesting, and a little disturbing, because it reads to me like pot is basically only legal for those with large lots far from neighbors, while it basically remains illegal for anyone living in a neighborhood. Outside the smell is a really high bar. I can tell you within a minute of stepping into my yard if the kid two doors down and across the street has been smoking in his closed basement bedroom, because the smell just carries that well.

You think? Lol! Had to laugh at this one. If it was me I would speak to the neighbors and be like” listen I don’t care what you do in your house but you probably havn’t noticed, but you gotta figure this smoke thing out”.

He probably doesnt realize it. Espec. As it’s still illegal. He might be grateful you told him. Be nice 2x then start getting nasty. Smoke in my kids windows. No way

Why involve the father. Just explain the situation to the son and give him a vaporizer as a present. I think that takes care of the situation but not an expert myself.

I'm late to this but if I were you I would confront him. It's going inside of YOUR house. And I don't understand why people keep saying to mind your own business and shut the window. I know half of y'all would be mad if you heard loud music at 3am. you would get mad if you had some body screaming at the top of their lungs into your bedroom window. now shes mad that her daughter is possibly getting contact high off of her pothead neighbors weed. and if she shuts the window, you're just restricting your daughter from ever getting fresh air in her room

For me it is just a matter of choosing which hill to die on. I chose to move to suburbia, to have neighbors and I know that means I may have to deal with things I don't like about those I live around.
I have enough experience with pot smoke to know its pretty unlikely her dd is getting a contact high in her bedroom, so if it were my kid that isn't something I'd be concerned about. If it was actual smoke (large visual plumes) coming in though I would speak to the neighbor and explain what is happening and ask if they could find another area in the yard to smoke. If it was just the aroma from having the window open I personally wouldn't have an issue with it and if my teenager did they are capable of closing the window themselves.
The other things you mentioned would bother me enough to do something, neighbor smoking weed not so much and IMO not worth starting issues with someone I have to live next too.

I am still baffled why folks would not just talk to the neighbor. IMO, this is a personal comfort thing, and one that affects a lot of people. I don't smoke anything so smoke in general nauseated and irritates me. I recognize that smokers are not always aware that the smoke travel to parts unknown. I would just let my neighbor know how that smoke was affecting my family and ask that he move to another area. To me, this is just a courtesy. Just as I would try to make my neighbors aware if their racket was keeping us up all night before taking it further, I would make them aware of their wandering smoke trail. I see no reason to be confrontational or judgey.

I guess the first thing that comes to mind is how surprised I am that this has been going on for 5 years and yet it's the first you've noticed of it yourself. I would think if it was coming in any window in the house that strongly you would have smelled it yourself in a hallway or whatever? I'm pretty easy going with my neighbors so I know I wouldn't do anything about it if it were my house but if you feel strongly about it then I'd just nicely say that smoke wafts into your daughter's room from their garage and could they smoke elsewhere. I wouldn't mention who is doing the smoking or what they are smoking. Extraneous info that really isn't necessary and might make the exchange awkward.

If there are children in your home, in BC you can't smoke inside the residence, in the yard outside is permitted. Can't smoke in a car with a person under 16 either.

It’s illegal to smoke in the car with a kid here too. Not sure about smoking in your house or not.

Yes. The problem comes when people want to inject drama into the situation. No need for it and why just not talk to the son. No big deal.

I've addressed this earlier in the thread, but no, it's not the first time I've noticed that he smokes. We all have know and smell it all the time when we are outside.

What I didn't know, is how strong it is when he is smoking and the wind is blowing it (the smoke, smell, whatever) into the bedroom window that is closest to their backyard and garage. We live in a all-brick house from the 1950's - these things are insulated! That bedroom window is the only window on that side of the house, and the kitchen window, which is never open at night and rarely during the day unless I'm trying to air out the smoke from me burning something (again!), is the next closest window. Our living area and other bedrooms are on the other side of the house.
