The Constitution Wins!!!!!!

Oh, so judges who defend our basic rights as guaranteed by the Constitution are "activist" and "illegal immigrants"? I'll bet you think that, if our government is allowed to search your house and seize your property without probable cause, it would only happen to illegal immigrants who don't speak English. Dream on. It's that incredible document called the Bill of Rights that prevents our government from showing up at anyone's door in the middle of the night to take their family away, just because the sheriff felt like it.

I thought Congress voted on the Patriot Act to help protect our country. Why does this turn out as an assault against the President by some here? Big surprise.

The Patriot Act was written by the Bush Administration, not Congress. (Though Congress does share blame for voting for it without most of them even reading it.)

And the Bush administration has been extremely vocal about the need for it to be retained as is.

I have to wonder, did anyone in the administration ever think that the powers they were granting to themselves might some day be used by a (gasp) Democratic administration? Now that they've set the precedent that the vice president is basically his own branch of government, how are they going to feel if Barak Obama becomes VP?? Now that they've decided that the Federal Government can perform warrentless searches, how will they feel if a Hillary Clinton administration performs them??

As with the WMD pile of manure, everyone was sold a bill of goods with the Patriot Act. It's being used for every questionable thing it's proponents said it would never be used for. It belongs in the trash heap. Our country's security deserves much better.

For the record, Democrats in the House supported the Patriot Act by a greater than 2 to 1 margin and in the Senate only a single vote was cast against it (Sen. Feingold).

I seriously doubt any member of Congress voted in favor of it without knowing all the provisions of it in full. If they voted in ignorance, then all the more reason to remove them. But I doubt that's the case with any.

The Patriot Act was a knee jerk reaction to September 11th that was never justified, never wise and never helpful.

You'd be very surprised how little most members of Congress know what they are voting for. And this bill was put together so quickly, even if Congress actually DID read everything they voted on, they would have had very little time to read this.

Members of Congress know exactly what they're voting for. Frankly, if any member of Congress didn't and voted anyway (again, I'd say there's zero chance this happened), they ought to be removed from office immediately. I find that FAR worse than taking a position I vehemently disagree with.

Exactly.


And certainly little time to digest it's ramifications. Not an excuse at all, but it was a time in our history when common sense might sometimes have been vulnerable to a little swaying.

Not in this case, the Constitution loses.

The case cited had probable cause to issue the warrant, however there was a mistake made. The Constitution does not guarantee against people making mistakes. Part of a fingerprint was misread? And that invalidates probable cause?

This is a judge rewriting the Constitution.
 
No doubt just a couple of activist judges who hate America and want the terrorists to win. Did I miss any thing? Oh yeah, the judges are probably illegal immigrants also who don't speak English.

So am I the only one that read this part of the story?

Mayfield, a Muslim convert, was taken into custody on May 6, 2004, because of a fingerprint found on a detonator at the scene of the Madrid bombing. The FBI said the print matched Mayfield's. He was released about two weeks later, and the FBI admitted it had erred in saying the fingerprints were his and later apologized to him.

So, if your fingerprint is matched on a detonator (by mistake in this case), that isn't considered probable cause? That wouldn't constitute probable cause prior to the Patriot Act? That is what this judge has ruled. This is not a win for the Constitution.
