We are currently waiting for ROFR. Day 10 and it's so hard to wait! This contract was our 3rd offer. High end of pricing I realize but I was done with offers falling through! I really hope this one passes so we don't need to start over.

I am still waiting to hear back on this one. I did contact the agent last Monday to be sure that we were still waiting and we were at that point. There was a new wrinkle with one of the sellers and we had to sign an addendum to the contract. I just hope that Disney was not waiting on that before taking it. I should know more this week and will post once I have a final answer. My agent indicated that the addendum would not cause the 30-day ROFR "clock" to start over.

You should have heard by yesterday then. Mine was went 4/16 and I haven't heard yet either. My broker said they have until 5/16 to ROFR. Which broker? Mine is TTS.

Wow that has to be so frustrating. That's a nice contract too. We submitted on 4/17 for an Aug BCV and have not heard anything. Weds will be 30 days. Beyond ready to move on and do something else with our money. Disney shouldn't get away with going beyond 30 days. You would think they gave it up for not deciding within the 30 days.
 
There is no such 30 day policy, I'm afraid. They can do whatever they want.
So where does the 30 days come from? Is there a time limit for when you get a refund on the deposit? Can it be out there with no word and you change your mind after waiting 35 days, you can still lose your deposit?
 
My understanding is that if they don't make decision by day 30 it is automatically passed. So day 31 it's yours. That's what I have always heard but I always wondered how true that was. Plus I suspect some brokers don't send when they say they send. For example mine said it was sent 4/16 which was Easter Sunday. So I just assume that 4/17 was more accurate. And wonder if it went even later. My deposit wasn't cleared until like 4/25. Maybe that has nothing to do with ROFR though.

I would hope the contract offered some consumer protections. I wish I had access to the contract right now to read what it says about the 30 days. I'm just waiting for my flight to take off, so accessing it from my phone is too annoying.

I will try to look at mine if I can find it. We are moving so everything, except my tablet, is on truck. Let me see if I can pull it up on email. Safe travels.

ETA... I looked and all contract states is that if Disney chooses to ROFR we get our deposit back. Does not stipulate date to ROFR by but mine says 'to close by 6/5'.

Thank you for checking! You have a lot going on with the move. Interesting. We still would love to own BCV. Hope it still happens. Good luck to you too!

That's super frustrating. If it passes, think of it as you sneaking one through. If it doesn't, then the deal was too good for DVD to pass on. I've had 2 BLT's taken. You care less and less as time goes on. :cool1:

If you really want VGF, which is my home resort as well, then just keep trying. One will get through. It isn't a property that they buy back a lot, at least for now.

The "30 days to decide" is just DVC folklore that will be reposted long after we leave the earth :). The condo declaration states that you have to "notify DVD in writing no less than 30 days in advance of the proposed closing date". In other words, YOU have to give THEM at least 30 days to decide.

In practice, they usually issue the waiver or intent to exercise ROFR within 30 days or less, but it has taken longer.

The standard recindsion time is 10 days from acceptance, I believe per Florida law. It's in the contract you signed when you submitted the offer.
 
It's funny my broker told me they have 30 days and for us 30 days is 4/16. That was their response to me asking if they heard anything. Must be some unspoken guideline the brokers and Disney have with each other s I have also heard about folks getting a contract because ROFR took over 30 days... so they got it automatically passed.
