Resale Contract Closed, but not getting contracted loaded until after 7/8/2022 over 60 days from closing? Advise wanted

I don't see why Disney can't just take ownership of the reservation and be done with it. The points are already tied to it and can't be taken back by the new owner. Convert it to a cash reservation "on paper", whatever. There's no reason why the reservation itself absolutely, positively, needs to be associated with the membership.

I'm trying to get more out of Disney with regards to when the reservation took place, who signed the forms that were turned into Disney for the delayed transfer. I'm very irritated with the whole thing but want more answers as to what went wrong, and how it happened.
I’d be worried that they are slow playing this. As others have said there is no explanation for why they won’t give you access right now and provide explanations and do investigations after. Unless they have something preventing this which would be even a bigger scandal. Regardless I feel no one is being honest with you.

What went wrong is someone sent a transfer of membership request to Disney dated after that trip, but “forget” to inform you.

Except the Title companies don’t notify MA that there will be a delayed closing ahead of time except during ROFR.

They simply don’t close the contract until after the trip..i have done 4…MA was notified that the contract changed hands after it closed.

I think what happened is that the delayed closing got missed, title company closed the contract because they were not aware as paperwork didn’t include it, sent it to MA, and then it was caught when MA saw the trip, contacted title company or broker and it was decided to hold off the transfer.
 

Member Administration is saying it can take 60 days to transfer ownership. MA will not do anything and the Broker is the one I would have to talk to, who has quit taking my emails.
Then I would call their bluff and demand they cancel the existing reservation, as it is your contract legally and you don't approve of it being there.

This is just a classic response. We know that people are getting ownership transferred in 7-10 days so that 60 day response is ridiculous. I'm on day 15 of waiting on my membership account to be setup and I'm getting nervous that there is something with my contract that is holding it up.... ugh... Thanks for keeping us updated on the info you're getting.

Wow. I would tell them that you know for a fact that this is not the case…but, regardless, since you are the legal owner, you have not agreed to allowing the contract to be used until they do it. and that you will be contracting FL timeshare bureau to look into things

Disney noticed the reservation and reached back out to the Broker, broker confirmed the reservation and told them not to do anything until after the reservation is completed. They said that is their steps. Does anyone know who to complain to about brokers down in Florida? (This was from a Manager at MA, he said he totally understands where I'm coming from, and mentioned there are steps I can take but wouldn't specify who to contact)

I don’t know specifically, but my answer to MA would be that since the broker isn’t the one who owns the contract, but you, then they should not be delaying transfer without your approval. You own it now so holding up your ownership should be your decision, not the brokers.

I would tell them that you expect it transferred and let the broker deal with the seller and their lost trip. That is not on you.
 
I totally wish it was. The manager stated even though title changed it hasn't changed on Disney's side until the transfer paper that they receive from the Broker says to transfer. I asked theoretically if the seller could keep pushing the reservation out and what Disney would do. The response was they would have to check with the Broker at that time to cancel or allow the reservation to extend. They couldn't put a freeze on the 2024 points either because they don't have the change date until after the reservation.

They don't need to transfer it out of the system, the points have been "spent". It's within 30 days. If they cancelled, the points wouldn't come back, they're gone. There is zero chance that there is no way they can move that reservation out. They could cancel the reservation, the points would be forfeited, and DVC could simply set up a new reservation number for the stay. They wouldn't even have to use their own points. The points would be consumed, and the contract in balance, the deed would be clear, and the reservation would survive.

How does the broker have any say in this? The deed has been recorded and you are the owner. What else do they need?

They need the transfer agreement, and the broker controls that. (I guess)
 
The broker’s refusal to talk to you tells me they know they screwed up and don’t want to own up to the mistake. There clearly was an existing trip that you were not aware of, nor was the title company apparently aware of. I know it’s a rare mistake but their refusal to fix the mistake is really unprofessional.
