Made an ebay mistake, can i fix it?

Looking for advice from all your ebay experts. Here is the situation: I won an auction in the end of august and paid via paypal. I apparently had an ebay msg around dec 7th from the seller saying that i had not paid and asking if i still wanted the item. I did not see this msg. To be honest I totally forgot about this item. The seller never filed a complaint. Fast forward to yesterday. I went into ebay and notice that i had 4 items that i had not done feedback on. I have been buying individual pieces of a dish pattern. So i quickly went and marked all the feedback as good. After i did this, i realized the one item had not shipped. i emailed the seller and she indicated that she never shipped it because i never paid and that if i thought i paid, i should dispute with paypal. I went to the paypal record and it indicated that i did pay so i filed a dispute. they immediately said (auto message) i was not eligble and marked it as closed. So at this point, i paid, left positive feedback but never go the item. what would you do?
 
There's nothing you can do at this point. You only have a 45 day window to file a Paypal dispute, so once that 45 days passed you really have no recourse. You are just out the money. You can always go through Ebay and file a dispute directly through them but I am sure they have some sort of time frame as well and since you ordered it in AUGUST I imagine that window has passed as well.
 
If you have proof that you payed the person, I don't understand why they just wouldn't send it to you, unless she sold it to someone else? That is odd that you payed and she didn't get notification of it back in August :confused:.
 
There's nothing you can do. You had 45 days from the date of payment to dispute the charge with paypal and/or file a complaint with ebay. Unfortunately, you're going to have to chalk this one up to a lesson learned.
 

You can send the seller proof of payment and see if they just made an honest mistake?
 
Yeah, not much you can do except send seller proof of payment, if you paid as you think you did. Though i'm confused...Did you really pay for it in AUGUST? I can't imagine why she'd contact you again in December. I would have moved on if I didn't hear from a buyer in five months!
 
Just because Paypal's rules are outrageous doesn't mean you aren't entitled to your item. I mean, if you mailed a check to someone and they didn't ship your item, you would file a police report, right? If you have a record that the amount was transferred from your PayPal account, isn't that the same thing?
 
Thanks. I made a major typo. Won late October Not August. . Paid nov 1st. Past the 45 days. Seller swears she did not get the payment. Seems genuine. Never filed anything. Sent me one note on dec6th. Relisted and sold them last week. She says she is filing a question so we will see.
 
Did you pay with a credit card via PayPal? If so, you can dispute via the credit card company.

If the seller truly did not receive payment, the ONLY way this could have happened is that the email the payment was sent to is incorrect.
 
Whenever you pay for something using Paypal, Paypal sends you an email showing the payment amount and who it was sent to. You should forward that email to the seller. There's no account information in the email, so you can send it safely. I'd do that to show the seller you did in fact pay her.
 
I've had this happen to me, although I noticed before a few months went by. If you paid and the paypal link through the ebay auction went to a dead email address paypal should also show where those funds were credited back to your account. The person receiving money has a certain amount of time to claim the money being sent to them. If the seller really did not receive payment then no one claimed the money and paypal should have closed the transaction and credited you back the funds. Last year I won a guitar on ebay for $10 (I was really excited about this) and immediately paid through paypal. A week went by and paypal showed the transaction was pending, but after 10 days I received an email from paypal stating the seller had never claimed the money and it was credited back to my account. I called paypal to see what the issue was and they said the email on record for that seller was not a good email. Needless to say I never received my guitar. :sad2:

I would check all of your paypal transactions since that date and see if there wasn't a credit to your account if the seller didn't claim the money. If there isn't and your account shows paid then I would let the seller know that at least you checked. Honestly I don't think there's much you can do because of how long it's been? If it wasn't a large amount of money and isn't that big of deal to you I'd just chalk it up to a lesson learned.
 
It could be that the money went into someone else's account. I paid for a football ticket through Paypal (eBay) once, and a few days later, the seller sent me a reminder to pay. When I went into Paypal, I noticed that the payment had been sent to someone else entirely. I'm not sure how it happened, but I had to file a dispute with Paypal for them to get the money out of the other account and put it into the right one. So, it does happen that Paypal makes mistakes. I don't know what their time policy is if the error was in their end.
