Would like some clarity on the rental situation

My only subjective comment is that I think the word ā€œcommercial enterpriseā€ was used purposefully.
Could it be that only stating it verbally could
mean something? Unless you record the conversation you can’t prove it.

A commercial enterprise is a business entity like a LLC, and with my limited understanding there is no way it could be an owner like everyone here.

Btw did anyone notice after the latest website maintenance a few days ago that DVC went back to the old 2023 terms and conditions when you modify a reservation? They changed it a few months ago for new reservations too. It seems like a thing of the past the changes they did June 1st 2025 - except when you call. Basically you are agreeing to one thing when making the reservations online, and you are agreeing to more strict terms when call in - sorry to say but that’s ridiculous. If you make you reservation online but call in to change the lead, you are agreeing to both set of terms, which one applies then?

I didn’t notice but find this very interesting.
 

Whether @Sandisw recorded the call or not I’m pretty sure DVC records the calls which could be obtained through legal requests.

Also getting through legal channels sounds like pain if you instead just had the recording yourself.
 
I feel like if you make sure to go out of your way to record your call to MS, you must being doing something you know deep down isn’t right and you’d like to pull a gotcha! on them if called out on it. But that’s just my opinion of course.

Of course it’s possible. It’s also possible they try to pull the system does not work during that time either.

I don’t know about you but I certainly don’t feel comfortable informing the cast member that I’m recording our interaction when all they are trying to do is help me.

Another would be that if you in the past experienced that the advice or what you have been told by MS was not correct you wanted to ensure whatever you are told going forward you have as proof or documentation.

It’s only proof if they consented to be recorded otherwise it would just be dismissed. You of course would know it happened but not if you were perusing legal action

Not that I’m seeing anything going that far, but as a European I need to adhere to my own countries rules, since I’m making the call from my own home. That means I can record any call without consent from the one I’m calling as long as I’m part of the call.

My intention was merely to point out that if MS or any other company tell you something it can be more than difficult to prove.

Beyond that, I did reach out and the offical policy from 2011 remains the same.

I do indeed log the time and date of my calls and I know they are recorded but it’s not for that reason….its to be able to include details if I need further questions answered.

What I can say is I continue to believe what I always have.

The intent of that clause was always about turning your DVC membership into a commercial enterprise which is the language that always exited.

It’s not about you being an offical one either. It’s about having enough reservations on your membership that DVC can reasonably conclude you are in it for commercial reasons.

Nothing from DVC, so far, officially statemenfs , communication or even enforcement seems to contradict a different interpretation of what they view as acceptable vs non acceptable renting on one’s memberships.

I know people want it to be changed and certain actions to ge officially part of the definition.

And we all know that DVC has the right to update and change things at any time.

I just believe that the inclusion of that word when I asked was done to help add more context given the current climate.

Just like the new messsge that was added when you call…

I appreciate the info here. I usually book online but I called member services today to update a reservation for my kiddos and the new "choices" unnerved me.

We are going on a Disney cruise this spring. Back when we bought our points, I learned here that swapping points for a cruise is a bad deal. You're better off renting out some points and using the money to cruise. That is exactly what I did! Mickey cruises aren't cheap, and neither are dues. Getting some of the dues money back if I can't use all my points one year is part of why I still have DVC even though we are empty nesters and vacationing all together isn't always possible. The interrogation before even speaking to a cast member annoyed me to say the least, and reading here calmed me down. THANKS ALL!
