This was before the trial. "Could" doesn't mean that they absolutely "would" after going through the whole trial. Maybe something about the mitigation factors got to someone. Obviously it didn't get to us, but we do have more info than they do too.They answered the question they could hand down DP. That means they lied? Come on if you can't hand down that DP then you need to state that in getting picked.

That tweet is wrong. They already said they can't reach a unanimous decisions, they're not asking what to do if they can't. However, they were given instructions to keep deliberating and ask questions if they need clarification on anything.
I was afraid of this. Lets not forget 5 of the 12 jurors only found premeditated murder and not felony murder; as to where the rest found both felony and premeditated.
I was a little concerned about these 5 going into this phase. I hope he/she/they can be swayed.
One of the talking heads on Dr. Drew (who is normally banned in our house) mentioned that each of JA's mitigating factors could have been tailored as a "gift" to each juror. (recycling program to influence an environmentalist juror; reading program to a teacher, etc.) Ridiculous to us but maybe someone drank the Kool-aid.This was before the trial. Well, that's comforting.HLN said that if there is a new jury, all of the interviews she has been giving can be shown in court.
