Penalty phase...what will the jury decide? (1 day poll!)

  • Death

  • Life (judge will sentence within 60 days, LWOP or Parole in 25 years)

  • No unanimous decision...new penalty phase jury will be empaneled.


Results are only viewable after voting.
Please tell me that this does not mean a new trial.

If they're truly deadlocked, a new jury will be selected and seated for the penalty phase ONLY, and then they'll deliberate only the penalty again. If they are deadlocked, too, it's automatically life for JA.

And what I want to know is, how the heck are they going to find a jury member now that hasn't in some form or fashion seen media coverage of this case and formed, even if only slightly, an opinion? :confused3

:confused3 ... This jury can't give up now ... I hope they just take a breath and work it out ...
 
Seriously? Seriously?! After all that has happened ... the Alexander family will probably have to live through this stupid penalty phase all over again. And you all know what happens if THAT jury can't come to a decision - it's an automatic life sentence.

WTH. They've only been going for 2.5 hours ... that's way too quick for them to decide they're deadlocked, IMHO. They're ready to go home and be done with this, and that's it. :mad:

No, BUT...all the facts of the case would have to be presented. How they do that, and how long it takes, I don't know.

I wonder if there are jurors on both sides who have dug in their heels and stated they feel so strongly that they WILL NOT change their vote.
 
I honestly do not know, Mare. I want to say LWOP, but I could be wrong.

I didn't hear it all but Beth Karas said that the state gets two tries in this phase and then the judge would give her natural life. I guess that means LWOP?
 
I was afraid of this. Lets not forget 5 of the 12 jurors only found premeditated murder and not felony murder; as to where the rest found both felony and premeditated.

I was a little concerned about these 5 going into this phase. I hope he/she/they can be swayed.
 
JM could also take the death penalty off the table and the judge could sentence her to Life. Would save a lot of money and perhaps stress for the Alexander family even tho they wanted death.

ETA: And we can always hope that Jodi is very UNPOPULAR in prison. ;)
 
Beth Karas just said that if the jury can't decide, then the prosecution can take the DP off the table and the judge can give Life ... And then another jury won't be needed to decide penalty ... I think that's what she said :blush: ...
 
They answered the question they could hand down DP. That means they lied? Come on if you can't hand down that DP then you need to state that in getting picked.
