I work with lots of people who are so addicted to E-Bay....but I've never gotten into it...and I don't trust just anyone with my money, especially a stranger!

It is definitely illegal to sell your unused tickets on Ebay. The tickets are non-transferable. Ebay knows this and they periodically audit and remove them if they're out there. I know a girl who tried to sell hers on Ebay and she was sent an e-mail which told her she was not allowed to do so. And, of course, they were taken off.

I'm so sorry that happned to you. My DH buys things on e-bay and it drives me nuts. He is so assured by e-bays policy, he's going to have to read this thread.

I have often scanned e-bays Disney tickets and dining vouchers and found them to be a rip off. Last week there was someone selling 6 lunch and casual dining counnections vouchers. We all know this is $66 but there were people bidding $168 for them. I about fell out of my chair!!!!!:rolleyes:

Whoa, what a terrible experience! If I was ever tempted to do this before I certainly won't be now. I'm really glad it all worked out for you though in the end.
 
I wanted to post this story so that other people won't make the same mistake I did. I had way to much faith in ebay, paypal, and the seller. He really seemed like the nicest person. We talked several times through email.

As far as it being illegal... ebay policy states that you can not sell partially used tickets, but they do allow people to sell unused tickets. Not just for Disney World but for other amusement parks, sporting events, music concerts, etc. The seller was not punished at all... he continues to sell on ebay. I even called Disney to report what happened and they said they are totally aware that ebay sells tickets as well as ticket brokers. In fact, ticket brokers have their own seller accounts on ebay.

I definitely learned my lesson! ;) It's good to make all your mistakes in your twenties anyway, right??? LOL :p

I know it is against WDW policy for the tickets to be transfered, but what makes it illegal?

EBAY's Fraud Protection Service will only protect buyers for the first $200 and they deduct a $25 processing fee. But they won't cover an item at all if it is illegal or doesn't meet their listing requirements, which these tickets didn't. They also ALWAYS want you to contact your credit card company first and try to get them to handle it. I agree 100% though that at the minimum EBAY should revoke this seller's account once they have been notified what he pulled off.

I'm really happy that you got your money back through the Credit Card Company.

Yes, but here's the kicker! Ebay will only consider giving you the partial refund *IF* you have a letter from your credit card company stating that they refuse to "charge back" the full amount. They won't give you a penny without that letter.

But they won't cover an item at all if it is illegal or doesn't meet their listing requirements, which these tickets didn't.

I'm sorry, but this is completely wrong. The transaction was never considered "illegal" and it *DID* meet all listing requirements. Disney park hopper passes are allowed to be sold on ebay and are sold there everyday. The only time they will cancel an auction is if you state in your listing that the tickets are partially used.

Here are the email I received from ebay reguarding this matter.

If you used a credit card to pay for your item, then you will need to contact your credit card company to file a 'charge back' or some other form of dispute. Since many creditors have deadlines for such actions, I encourage you to take this extra step as early as possible. If you are unsuccessful in obtaining the charge back, please forward that information to your eBay Claims Administrator.

Please be aware that all fraud protection claims must be filed within 90 days from the end of the auction. To file a fraud protection claim, please fill out the claim form, at the link provided below, and mail it to the eBay Claims Administrator:

Here is the ebay policy for events in Florida. As you can see they *do* allow people to sell event tickets (like WDW passes) as long as they aren't used and they aren't over face value. Neither the seller or buyer (me) live in the state of Florida.

For events in Florida, eBay permits resales of tickets by sellers in Florida at no greater than face value plus $1 per ticket for all entertainment events held in the state. For tickets to Florida events sold by non-Florida residents, bidders within Florida may not bid above face value plus $1. In addition, eBay does not permit the sale of multi-day or multi-event tickets that have been used at least once for admission.
 
but the tickets were used and that is what makes them illegal.

I understand that you were unaware that the tickets were partially used, but that doesn't change the fact that the item itself was illegal and should have never been listed.

As I said, this sellers account should be revoked because of his fraud and misrepresentation.

As I said -- I'm really happy you got your money back through the credit card company. Thankfully their online protection policy is much more helpful.
 
The seller just played dumb, he somehow convinced ebay that he was totally unaware the tickets were used. I'm not sure if I believe him... I know he doesn't speak English too well, but he kept assuring me he bought them at the TTC, when he actually bought them on the street. :mad:

I know for a fact he's still selling. I check his ebay profile about once a month to see if they have suspended him yet. Also I have noticed that he still does business through paypal, so they didn't suspend him either. It's just amazing!!! :confused:
 
You know, I actually cried when I read this post.. I put myself in your shoes and when you said that you just ran out to the curb and started crying - well - that's when I started crying.. Like you, it would have nagged at me throughout the entire trip and definitely put a damper on things..

I'm just SO glad that you got your money back.. It was an honest mistake on your part - you trusted someone who seemed trustworthy - and you shouldn't beat yourself up for it.. It took a LOT of courage to come on this board and reveal this so that you could prevent the same thing from happening to someone else.. Something tells me that you are a VERY special person..

I am seriously missing something here. People keep saying that selling these tickets is "Illegal" what do you mean by this? Is there a criminal statute that makes this illegal or do you mean that it's agains the policy? Just because the tickets say that they aren't transferable doesn't make it illegal to sell them it makes it against WDW policy (or Ebay policy) and makes them subject to not being honored, I assume. I do understand that misrepresenting them would constitute fraud, but I am trying to figure out how selling the tickets in good faith and w/o fraud is "illegal".
 
Not being a lawyer I can't find the law. However, it is my understanding that Florida law prohibts the sale of these partially used tickets. Disney and Florida law do allow ticket brockers to sell new tickets so I think the issue is the fact that once you have used a ticket it is yours. Years ago when they just stamped the ticket for the date used it was pretty easy to tell if a ticket was used, now... you just have no way of knowing until you hit the park.
