Height Requirements...with shoes?

Please know I am absolutely a rule-follower and am not going to try to sneak my child on to a ride by stuffing his shoes or something, but I'm just curious if, say, on Splash Mountain the stick is 40" from the ground? Or a little higher than 40" to allow for reasonable shoes?
 
I am pretty sure it is from the ground. My daughter (we found on the last trip) can only ride Primeval Whirl if she is wearing her sneakers, not keens or flip flops. So shoes really do play a part.
 
It's 40"...period. :) I was a CM and told that if the stick cleared the child's head, it was a no go. My son out of his shoes is 42 inches...in his tennis or sandals, he's 42 1/2 inches. He's only 3. :faint:
 

Yup, 40 inches from the ground, but sometimes the ground is sloped near the marker. Make sure your little one stands right up next to the marker to be measured, rather than a couple of inches downhill.
 
As far as I know, it is is 40 inches from the ground, regardless of footwear. Although there have been rumors that a CM will ask a child to take off shoes if the CM suspects the child's shoes have extra-thick soles or have shoes stuffed, or of the child is wearing heals. I have never seen it happen, personally, so I cannot vouch for the veracity of the claims.
 
I just asked this a while back. My DD is 391/4 with shoes!!! I feel that this is close...we are going to get her measured at rides and see if she passes at any and warn her ahead of time that she may not be big enough yet. Many people told me to go first thing in the morning because the day tends to wear you down..literally. Also know that every CM is different. When we took my DD at 2 we knew she was 36inches tall but a CM at barnstormer said no...we went back later and she measured fine and got to ride.

My oldest was definitely not 40" by the doctor's measurements but got to ride all the 40" stuff on his first trip to Disneyland. We told him he wouldn't get to ride but on a whim my hubby had a CM hold the stick next to him and he was THRILLED to go on Splash Mountain even on a chilly February evening. :)

I'm fairly certain my middle kid will be 40" by the time we go. He's 39" without shoes today and we're going in November.
