But smokers is already separated out from COPD at least for NJ. I'm not debating smoking for priority (already gave my stance) but if they mean diseases associated with smoking as opposed to a person who smokes then that should probably always be clarified. I think smoking due to its addictive properties might be why they used the wording "medical condition" because yes smoking is a choice but smoking is also quite addictive due to the chemicals and its affect on one's body not only in the addictiveness but also the chemicals.“Smoker” can be a relative term, and may not necessarily mean active smoking. It could mean someone with chronic lung disease, like COPD, even though they aren’t currently smoking.

In my state there is no such category that says "smoker" but COPD is covered in Phase 3.
