yikes in all my years buying/sellling on ebay first problem,.....

back on April 2rd won 3 seperate clothing items from same perons....one shirt i needed this month,..,...but since she stated she shipped expediated usps..figured it would be here in 3-4 days.....she gave me shipping discount of a few dollars which i thought was nice when I asked her if she gave a discount on multiple items.. I pd right away and she shipped it April 2nd

fast forward april 16th still havent recieved item..so i email her to see whats up...she says they were shipped here is shipping confirmation and for me to call post office to find out why I havent recieved...

So i did...turns out she had changed shipping to parcel post and didnt tell me....and post office says it could take a while for me to recieve...

i contacted seller and told her I was unhappy about her changing the method of shipping and that one of the items i had needed right away....she told me to let her know when I recieved item.......that she changed shipping method since it was 3 items that it exceded weigh limits for expediated so she shipped parcel post.....she doesnt see that she did nothing wrong..

I contacted her again on 4/22 to tell her no package yet..which she can see on shipping confirmation.....she said she woul refund my money once i recieved items and shipped back to her?????

well today I recieve an pkg in mail...looks like its been thru war and back....ripped open and resealed with only one item in it..not the 3 i brought...she wants me to pay now to ship back and than she will refund.....im at a loss..do i contact ebay.......paypal...cc company.........i sent her another email letting her know I would gladly ship her shirt when I recieved my full refund but I was NOT paying for shipping it back......am I wrong???? this is the first time I have ever had to deal with any ebay problems

start a claim on ebay and paypal stating you only received one item, that right there is a major problem. Also make sure you save all your emails with the seller as your proof that you've tried to resolve the issue and now need someone to intervene. Did she confirm that all three items were shipped in the same package?

yes she said all 3 items were shipped together.....

If the post office opened it or it was damaged while in transit they usually put tape and a small stamp or note on or inside it stating what happened.

eBay has a resolution center just for things like this and they work pretty quickly! Go now and start a claim stating exactly what happened, the change in shipping speeds, the one item that was delivered instead of three.

no note or stamp......

Just wanted to add that is she put expedited shipping from USPS then that would be any type of first class or priority mail which takes 1-3 days in transit. If it was sent Parcel Post that's an economy shipping service, I would have started a claim right then.

I thought that if you listed expedited shipping you had to send it that way no matter what. *runs to check eBay policies*

it irked me that she changed it.....but as long as I got items on time..it was okay...one shirt was for a play perfomrance so now need to start looking for a different one........and now that I just recieved one item...now I am a bit miffed.......i spent over $10 to ship 3 items that weighed about a lb total..........

start the claim in the resolution center. They'll walk you though everything.

Actually first class mail is also considered expedited shipping - I know that isn't how this was sent but first class is also included in expedited.

If she wasn't going to ship the way that was originally in the post, she should've notified you first before she decided to send it parcel post.

I had a bad experience about 8 years ago. I shipped a couple of items to a lady in California. I'm in Texas. I was a newbie to ebay so I didn't purchase the tracking on it. But it was sent through USPS. Weeks went by and the lady hadn't received her package yet and was livid. She had every right to be. I refunded her her money and everything as she demanded even though I knew that I shipped it on the day that I told her I shipped it. I just didn't get delivery confirmation with it. Surprisingly, she emailed me 4 months later and told me that she received the package and that it was indeed postmarked on the day that I had told her. I felt horrible for what happened but was also super mad at both the postal service and her for being super rude to me. She left me negative marks when all the confronting was going on about the package and turned me in. From this point on, it's delivery confirmation all of the time.

But, in your situation, I would start a claim. 1) You didn't receive the shipping service that you paid for. 2) You didn't receive all of the items. Keep ahold of all the emails as it will help you.

Was it postmarked the day that she claimed she shipped it?

yes, first class is expedited but as of May 1st it's being dropped to standard. There was a message on my selling page about it.

Not so much anymore. I have received quite a few damaged boxes from the USPS without any notes.

Here's the thing, if the seller responds to the claim stating they will refund when the item is shipped back, the buyer will most likely have to pay to ship it back in order to get the refund. Ebay pays for return shipping most times when the seller doesn't respond or states they won't take a return (in which case ebay forces them to).

Over Xmas I ordered a new tree skirt and it came in a package that was all torn up. My post office resealed it as best they could, stamped it and wrote in what happened. A quick 2-3 words about it being torn in transit. The skirt was fine so I didn't mind.

I guess it's luck of the draw.

$she just refunded the 2 items not sent....and partial shipping.........so now I have a shirt that was suppose to go with the skirt i never recieved......and she shipped it parcel post ....ugh dont know whether to just leave it be...I rather her just take the shirt back but I dont want to pay shipping.....may need to call back to see about how to open a case for the shirt now???? or just leave it be??? not sure a $17 shirt is worth the aggravation

A penny is worth the aggravation when you are lied to.

that she changed shipping method since it was 3 items that it exceded weigh limits for expediated so she shipped parcel post

This could not have been true since she only sent one item.

Open the claim. She is not allowed to ship a different method w/o your OK on it first. If she's lying to you, she's probably lying to other customers too.

It is very easy to open a claim. Go to "My Ebay" and find the item you purchased. Click on the drop down menu over where is says "leave feedback" etc. Click "resolve a problem". It will take you to the resolution center and walk you through the whole thing.

she has great feedback...over a 1000 with only 7 neg....ive looked overe the resolve problem but dont see where it lets me pick changed shipping methods as an option

I don't think there's a specific ebay rule about shipping, other than it needs to be shipped out within so many days after payment.

See:
http://pages.ebay.com/help/policies/selling-practices.html#shipping

1. You received the item you purchased, albeit not in a quick manner;
2. You received a refund for the 2 items which you did not receive.

I'm going to guess that ebay isn't going to side with you on this since she gave you a discount for the multiple items being shipped together. The seller can say the rest (assuming there was any extra amount after deducting the actual cost and fees) is a "handling fee"

But good luck!
