I am far from an expert but I can't believe that would cause a mistrial. All it would do was take the death penalty off the table. Just because one judge in Miami declares it illegal doesn't mean everyone on trial gets to walk free. When the story of this judge in Miami last week, all the local commentators were saying it wouldn't result in a mistrial. Only repeating what I heard at that time.

mte!!!i would think this would make it worse for casey. A non-dp qualified jury will just convict her more easily.
