Astronaut Kidnapping Plot: Anyone See This?

While she is charged with attempted murder there is no way those charges are going to stick, no way the attempted kidnapping either. This is really going to be interesting.

Also, Shipman filed for an Order of Protection here, and a temporary one was denied. Hearing will be February 20th in Brevard County.

I was wondering that--there seems to be overwhelming evidence that she planned more than a desperate conversation. She plotted something.

What is required for an attempted murder charge to stick?
 
I believe proof would be needed that she intended to kidnap or murder Shipman. Just having those things doesn't mean a whole lot, circumstantial evidence. Remember...beyond a reasonable doubt.

I just feel sorry for Ms. Shipman--she felt threatened and in danger and it seems like it will be all brushed under the rug as an unfortunate circumstance.:sad2:

Well, I've got to tell you, if I were on a jury, that would be enough to convince me. She didn't just don a diaper, print out directions to the woman's house, rush to Orlando, and find her at the airport while carrying a knife, a steel mallet, and pepper spray (along with other assorted goodies) just to talk to her. :sad2:

Sometimes there are objects in my car unrelated to what I may be doing at the time. Sometimes there is a firearm in my car.

I am going guess now that this all will be pled out to misdemeanor battery (unless there is some documentation stating her intentions).
784.03 Battery; felony battery.--

(1)(a) The offense of battery occurs when a person:

1. Actually and intentionally touches or strikes another person against the will of the other; or

2. Intentionally causes bodily harm to another person.

(b) Except as provided in subsection (2), a person who commits battery commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

(2) A person who has one prior conviction for battery, aggravated battery, or felony battery and who commits any second or subsequent battery commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. For purposes of this subsection, "conviction" means a determination of guilt that is the result of a plea or a trial, regardless of whether adjudication is withheld or a plea of nolo contendere is entered.
 
I don't think she 'snapped' at all. I think she planned to kill this other woman and lost her nerve. She wore a wig and a trench coat, she had items that suggest she wanted to do more than talk, that she meant bodily harm.

I think she was planning on killing her and didn't want to be later recognized. I think she wore the diapers to get there faster than police, or a jury, would find possible. (ie alibi, 'I couldn't have possibly been there') I think she looks crazy in her mug shot because she was wearing a wig before the picture was taken. Y'all wear a wig for hours and then take it off and get your picture taken...you would look 'crazy' too. This one is not crazy, she plotted and planned a murder...motive? Jealousy. It's a an age old reason. JMHO

She attractive, extremely well educated and wore an adult dyper on a 900 mile drive to avoid toilet stops.

So, she's good looking, intelligent AND practical.

You hit the nail right on the head, but the apologists for aberrant behavior here will inevitably disagree with you, insisting she was some kind of "victim."

You are right--but I also thing of the murder for hire...a murder doesn't have to be attempted in order for the solicitor to be found guilty of attempted murder, do they? I'm remembering some cases where this was found to be so--but not sure if they are Florida or elsewhere.


But it could be the semantics--she didn't "attempt" anything other than the mace thing.

But I wonder what the crime would be for plotting to do so but not carrying it out.

They do that with folks who make bombs at times--while they never attempted anything...they were planning to.

I think maybe the police bungled it, when it comes to the charges filed. Not sure what she should have been charged with, but I am sure the police know exactly what she planned to do. (I say maybe because I am not sure of what charges should have been filed)

From the description of the items found, it sounds like she planned on killing her and then disposing her body in garbage bag/s.

If anything, the victim should be thanking God she reacted the way she did. I suspect that if things went differently and she did let her in the car, she wouldn't be here to talk about it. Obviously, we will never know...but it sounds to me like a murder attempt gone wrong. JMO
 
With Murder for Hire, there is usually proof of such a "transaction". A lot of times the one approached to do the murder goes to the police and a sting is set up.

Sure you can look at all the items she had and figure what she MAY have been planning, but is it known for sure? Unless there is some proof out there, it is my feeling that the charges are not going to stand and it is going to be pled down, and in the end the most she will get is probation. Seriously. Her punishment will be the public humiliation.

There is a theory floating around that OPD was upset that she got out on bail for the attempted kidnapping charges and quickly filed the attempted murder charges hoping she would have to stay in the clink. I don't really buy that, but I am willing to bet there is SOME REASON (other than the obvious ones) that the charges were filed.

Again this all predicated on not knowing if proof exists on a kidnapping or murder. If there is such proof, then the charges will stand (but may be pled down to a lesser felony).
 
Miss Jasmine~ That's my husband's point of view also. I do believe the woman was attempting to do more than just scare the victim.:sad2: However, like you said, is there concrete proof?:confused3 We'll have to wait and see how it plays out.:confused3
