W2 ADP help...

So former employer went out of business in December. We had direct deposit with ADP. All of a sudden the deposits just stopped. Long story there lol. Having always gotten W2s from them in early January, I am just getting a bit nervous. Dont know much about the ADP thing.... if the employer went out of business will ADP send out those W2s? I have a suspiscion that the employer just stopped paying ADP.... Like all others lol. So if ADP hadnt gotten paid are they still obligated to send out W2s?

I don't know the answer. But, we use ADP at my office, and we haven't gotten our W2s yet, so they may still be in the works.
 

Our company also uses ADP. Have you signed up to their online site?
There you can access your paystubs and previous years W2s. When they have your 2012 W2 ready they'll upload it. Sometimes I can access the electronic version before the paper one.
Sounds like you're concerned that this employer isn't even going to file, is that correct?
 
Apparently adp messed up on figures and had to redo them. Beyond frustrated.
I didnt know u could pull up your w2on their website. That is for anyone whose checks came adp?
And no..dont trust that anyone is taking taxes seriously there.

By law an employer or payroll service company has until Jan 28 to mail W-2. as far as your company going out of business ADP has to mail out W-2 no matter what. They were the company that collected the taxes from your pay and they must produce documentation of what was collected.
 
Do you still have your pay stubs? They would come in handy if there were some discrepancy about how much social security tax and income tax should have been withheld.

Compare with the W2 you eventually receive.
 
I received my w2 from ADP appox 1.5 wks ago. I no longer work for COmp.
 
I will be so glad when all is said and done with the taxes...crazy year lol

The deadline is the 31st.

ADP is the payroll processor. It is the employer that is responsible for the taxes and the W2. ADP will not provide W2s to employees of their clients.

If the employer went out of business, ADP will probably not issue W-2s, as they are no longer under contract. So I would assume you will not be getting a W-2 on a timely basis unless they employer does it themselves. (On the plus side, they generally debit the employers account to collect pay and taxes prior to pay date, so at least taxes that were withheld from your taxes probably did make it to the IRS!) Go ahead and file using the steps from the link posted. The IRS will go after the employer (they have records of funds received, but no W-2s) so don't be surprised if you get a W-2 eventually. Meaning in a year or so.
