United Airlines Forces Man off of oversold flight

Not sure if this has already been posted but the passengers who recorded the incident violated United Airlines video policy.

The idea that anyone could be "prosecuted" is rather odd on its face. They could certainly punish someone for it, but that would typically mean tossing someone from the flight for violating the contract of carriage. There might be some other things that could be done, such as cancelling a future flight or even cancelling loyalty points.

Blacklisted from United flights

From the video it looked like he was knocked out cold while he was dragged out limp. All of his injuries could have easily happened in the initial slam into the armrest.

Yep. Could have happened at any point, I was just saying that's what we know. I think if the teeth came out initially we might have seen it or maybe not since it happened pretty fast and then he was just being dragged down the aisle.

First of all they would be idiots to try to do anything about it.

Secondly I wonder how easy it would be to do anything about it when according to the article they have implicitly allowed other videos of funny safety demonstrations to be taken and shared.

I agree with the other poster that they wouldn't even consider prosecuting them. But there are lots of things United could do such as taking away elite status, canceling the loyalty account, or possibly even blacklisting them from future United flights.

I understand the things they could do if they wanted.
What I wonder is if someone say took them to court over it, whether it would it hold, given that they haven't taken action against others who have broken the policy by taking and sharing videos of the crew (look at our tube on all the safety demonstration videos etc)
I know this is very different (and a different country) but here in NZ if an employer allows a behaviour (such as sharing inappropriate photos via staff email addresses or being late) by not taking disciplinary action then you cannot discipline them later (even if the behaviour is ongoing) so you either need to a) talk to someone from the first time they are late and keep a record-even if it is 1 time 5 minutes late you need to talk with them and advise it is unacceptable or b) send out a company wide message that advises that the company has allowed x behaviours to slide and that they will no longer be tolerated then act the next time an employee does so.

My point being it would seem that United can't cry these videos break our policy when they haven't to other videos

That would be cutting off their nose to spite their face. It would only make their image problem worse.

Take them to court over what? If United blacklisted them? United can blacklist anyone at anytime for any reason.

And I am sure someone can sue them for whatever action they take: blacklisting them, taking away points etc. They can still say United had no right to punish them for a policy they havent otherwise enforced.

"The use of small cameras or mobile devices for photography and video is permitted on board, provided you keep the purpose of your photography and video to capturing personal events,"

None of the other passengers have heretofore complained about being filmed so there really isn't much United can say. And if they try they're just shooting themselves in the foot even more.
