Social Security Disability Payments

Thankfully I do have enough quarters! THAT I checked into ASAP!

Thank you, I will bring it up, when I go before the judge... when I eventually do! When they said on average, it is 4 years before going before a judge, they were NOT kidding. :guilty:

Funny thing is, I was on it back before I got married. And then dh's income brought us over by $50 and I lost it. I did go back to work until 3 years ago when I started having iron issues, and my seizures picked up, and my arthritis got much, much worse, and continues to do so.

I want someone to represent me (and I'd go in) but the places I've called here in Phoenix, no one has called me back. I called Binder and Binder, and they wouldn't take my case until I had a date. :(

the higher paying one is usualy ssd-it's the one you have to have enough quarters in the ss system to qualify for. if it's ssd there's no income/property/assett limits. ssi on the other hand because it's technicaly a 'public assistance' form of social security does have income/assett/property limits.

you might want to check and see if you have enough quarters in the system for ssd then the cars would not be an issue.

if it is ssi you are looking at you might want to ask if there are any provisions for excluding one vehical from consideration. we could do this with some other public assistance programs for reasons like a medical necessity that required one vehical to be with the disabled person at all times with the other vehical necessary for the income producing activities of their spouse.

I am on SSDI and I get 1/2 from them and the other 1/2 from my LTDI.
I had to pay back the lump sum and then some. I get my LTD on the first of the month and SSDI at the end of the month so my LTD said I owed them a month SSDI extra and had to pay $1200 more than I got from SSDI. That was a tough month because I had no income since I had to give it all to LTD.
I pay taxes on the LTD but didn't have to claim the SSDI. I did my taxes with tax-act and they figured it all out, but it was confusing. You might need to have someone do your taxes if you don't use an on line tax form. I know I wouldn't have known how to do it and would have claimed the entire income.
This year I am not getting a COL adjustment from my LTD and I won't get any increase in my SSDI so things are getting tough here.
And of course they just released a study that people in CT have the higest incomes of all the USA. Not here in my town, or on my street.

I work for the largest disability insurance company in the country. In most of our policies SSDI is an offset (which means it will be deducted from your monthly amount). Also most policies will also offset for SSDI payments to children under the diaabled persons SSN. Take a look at your policy again to see if family SS is an offset. If you don't have a copy of your policy call your employer. Unlike what some people have said we are here to help you through this difficult time.

I have a hard time buying "they are here to help you" as you say -- they want their money back and don't really care what type of jam it puts you in. I work in the insurance area as well and know I could care less what your sob story is the payment you owe is owed.. or more in my area - I don't owe you for the coverage and crying over the mortgage ect won't change the policy rules..
so I am sure LTD companies are the same - they want their money back per the policy language -regardless of the hardship the insured is having... its life..and business..:rolleyes1

Man I am so glad I paid into both short term and long term disability. I don't see how someone who goes on to SSI/SSDI could pay back something like LTD. :( Not easily or quickly.

I totally grasp and understand the whole you don't double dip and I am very good and on board with that.. but totaly against telling folks to pay back more than they received in SSD/SSDI that is just dumb.
Oh you would like 5k more than I get - and I don't work - sure let me go down the basement here and make up some money for you.." what do these companies think sometimes....

I'm sorry you feel this way, I know how hard it can be, but how would feel with no LTD at all? Yes it is about the money, if you don't want to pay the company back that is your right, most of the time the company will withhold any benefit that is payable until the overpayment is made in full. My best advice is to work with the person hadling the claim.

Well since I work in a insurance industry - I would NEVER be without some sort of LTD/STD and life insurance.. so that woud never of been and issue regardless.. My point of what is wrong is when an LTD provider wants more money back they you are being paid..I get you have to pay them back, BUT that amount should NEVER exceed what you got. thanks all I am saying.

I didn't get that they were asking you for more then what you got from SSA. Ask them for a detailed breakdown of the overpayment to see if they made a mistake. I work in the financial area and our error rate is very good but it's still around 3%. Usually when I see calculations that ask for more money then what SSA provided it is because of timing. Where the insurance company pays current and SSA pays a month behind. But usually it's not very much more, maybe a month or two.

We could really use SSI too but I make to much for a family of 3 to qualify for it.. sucks -cause strapped is an understatment - after paying bills car payments car insurance and everything else we have like 100.00 a month for spending. and we have no CC debt at all so go figure.
You do know that you can't qualify for both. And the benefits for SSD are MUCH better than the benefits for SSI. My DH is disabled due to a childhood injury that just got worse with age. He worked for as along as he could, so he definitely qualified for SSD. His ex-wife somehow qualified for SSI (mental illness). When the kids were minors they lived with us. DH went down to ask about discrepancies in the checks (whole other story) and he was told that her SSI didn't qualify the kids for any money from it. Don't know if that's true or not but they were able to get money from his SSD only.

definatly check on it-with ssd having multiple cars should'nt be a factor at all (we've owned as many as 3 vehicals during the time i've been on ssd).

you might check with your local social services to see if they have ss advocates that could help you free of charge-the county i worked for did. they would review the reason a person was denied and help them gather the necessary information for the appeal and hearing process.

actually we were told by our SS lawyer that we could have both SSD and SSI together is we qualified money wise. problem is we dont...
