Yup, I just read the new agreement. However I didn't see if it says that in case of a force majeure, where a member would have to essentially pay back David's for the 70% received by Davids from the renter and forwarded to the DVC owner, that David's in turn would reimburse the renter, so it must still be non-refundable to the renter's? (didn't get that far in my reading}.
So if the renter has paid David's and received a confirmation number, and David's pays the owner the 70% deposit and then there's (GOD FORBID) another situation like COVID, David's expects that 70% back from the owner and it's just theirs to keep? Owner would get back the full points that were on that rented reservation and hope they weren't banked or borrowed? Am I missing something?
I'm guessing this was prompted by the pandemic causing David's Rental Co some major losses.![]()
Yep. David's keeps the renter's money and issues a credit to them. From the renter's sample agreement:Yup, I just read the new agreement. Owners refund the money and the renters are given a voucher to use for a future trip.
The thing is that, as an owner, you could be stuck with points that can’t be used or rented again and end up with no money and no points that do you any good.
So, the real loser in all of this is the owner, which is why I won’t use him.

Hasn't disney done their best to help those with orphaned points from 2020, though?
How could David enforce payment back from an owner based outside Canada? Court action would be very difficult and expensive.Owners refund the money and the renters are given a voucher to use for a future trip.

I agree and I feel the same way. It’s a very weak contract for him to try and enforce. You agree to it in the contract. Of course, anyone who doesn’t want to abide by what they signed might get away with it, but it does say he gets to take you to court in Canada
But, the point is more, as an owner, I am not getting into a contract with terms that IMO are not owner friendly.
8. DVC Member agrees to modify reservations as directed by The DVC Rental Store including but not limited to the following:Hi. I just read the agreement from the DVC Rental Store. I'm wondering how often #8, modifications to reservations occurs? It sounds like a major hassle and it's not been our experience with David's where a guest cancels a trip and the member has to cancel, and rebook for someone entirely different. Is this as much of an issue as I'm thinking it may be?
TIA
