Rented points problem

A few questions/thoughts.

1. If in the previously linked thread the answer was that you are not responsible for the charges made back to the room, how come in this case the OP is being told they are responsible? Is this just strong arm tactics?

2. Secondly why I understand why owners are (and should be) responsible for things that go on in the rooms that they rent out, I don't understand why you would be responsible for charges renters make in the parks. :confused3 Renting a room does not gain them access to the park, they have to buy a park ticket to do that. So why would you then be responsible for someone else's actions outside your quote un-quote property?

I think what we have to remember is that DVC simply puts a hold on your membership if you choose to let someone else use it and there are issues (room damages, unpaid charges, etc.).

Since you are the one who allowed guests or renters to use it, you are the one that has to work to get them to resolve the issue with Disney.

Technically, DVC isn't really making the bill yours but rather forcing you to do the leg work to get it taken care of by putting the hold on the membership.

Once that happens, you are forced to resolve it by either paying it off yourself to unfreeze your account quickly, or finding the renter and getting them to take care of it. Either way, it is an issue for the owner and I feel horrible for the OP that they are forced to go through all this.

while i don't have any advice to get back what was stolen , i
like to offer some comfort words. [ in my line of work, we often must help
those being done wrong by others. ]. lucky for us, there are a few principles
that helps ease emotional pain to victims. just because one can takes
advantage of another , in no way makes doing so right. i think most here
are feeling this because your observation is correct...it could have happened
to any of us. and it's impressive how so many are rallying around, offering
support. and because another mistreated you, in no way meant it was
deserved or it was any fault on your part. it is 100% their responsibility, and
a reflection of their own "lacking". nor can they ever escaped the memory
of being a thief. from time to time, they will experience reminders, where
their intentions to fraud came form their hearts. not something easy
to remember. because what i learn in life, the best way to prevent
regrets, is to do the things today that one will want to remember
tomorrow. something else....one becomes what one practices. so
if one steals..one is a thief. we call it reality orientation. only those
practicing the things that makes life special, are only the ones that are admired.

* when we took our daughter on her first trip. some cruel person stole
our camera & our lil'ariel first pictures with the disney's ariel. worst
we run out of film so we had to kodak "magic kingdom" prices for that
film. & it was only a few pictures. wonder if they saw waht they stole.
we were upset because we didn't think we would be coming back.
but what happenedd, others rally & gave us more magic we would have
never thought of. and as our destiny turned out, we can go any time
whenever. just our experience that i hope gives you a new hope to build
something even better that the 1400 would have..if it hadn't happened.

after all, walt didn't named it "magic kingdom" for nothing...

It's problems like this that keep me from renting out my points. It even makes me gun shy for doing a direct timeshare trade too.
 

I feel the same- bad for the person this happened too and scared to even try renting points. It seems a direct transfer may be the only safe way to handle extra points if you choose to recapture some of the costs.
 
Here's a question: Why does DVC make it against the rules to transfer points for money? This policy of making Disney's credit card issues the owner's problem has several posters here stating that they would prefer a direct transfer for money. Does DVC care if they are increasing the motivation to break that rule?

Likely because Disney doesn't want to have any legal liability, as transfers are final transactions.

For instance, many people transferring their points require 50% down, and final payment after the transaction is completed. If Disney formally approved of transferring points for money, they have the potential of being involved in a legal dispute between members.

I agree that it's something legal, though I suspect it has to do more with wanting there to be no official dollar value placed on the use of the points. The POS says over and over that the points are just a representation of the property ownership.

Either way, the lawyers probably don't really care if we transfer points for money, they just need it to be against the rules. They'd rather have another way to get money from deadbeats (though our memberships) than worry about whether that policy encourages a breach of the transfer policy.
 
I get the whole owners responsibility for the room thing, but as a owner I am not extending charging priveagles to anyone. When I have stayed on CR I was told they would put a hold (cannot remember the amount) but a hold on my cc until check out, this was at FW cabins. I sure hope dvc forwarded all documents, credit card, checkin signatures, signatures for charges to room, etc... to OP since they are the ones that have the proof that these people made the charges. This is crazy and I for 1 would consult a lawyer thats just me.

Since the POS states that the renting Owner will be responsible for the acts and omissions of their renters, that would included omitting to pay their bill.

Actually I have always wondered when you rent just how much responsibility of a renter you would be held accountable for, such as in the case of a crime committed by your guest. :confused3
 
I know you're probably too professional to do this, but since you have a name, can find out where she works, know where she lives, can get her phone numbers, and I bet come up with e-mails and everything esle, you could make her life a living h...e...doublehockeysticks.
 
To anyone who is interested, after several conversations with MS, I'm stuck paying this if the renter does not. I've already Emailed and called the renter multiple times with no response. Amazingly, when she did answer the phone and I said my name, the line went dead (honestly!). I can't believe this as this renter works at the University of Tennessee in some professional position. I had Disney fax me the folio showing all of the charges and they certainly all look legitimate. I live in Massachusetts, the renter is in Tennessee. I'm waiting to hear from my nephew who is a lawyer to see if small claims is worth it. For $1400.00, I'd fly to Tennessee for a small claim action if I had to, I'd still be ahead. I'll post if I can get this resolved. All I can say is be careful. I know this renter is familiar with this forum and is very knowledgeable about DVC, even telling me she is an owner. She used my points as she said she didn't have enough for what she wanted to do. She had a great trip, cost me 186 points which I received $8/each and I get to pay for their food and entertainment. I'll end up making about $100 for 186 points, what does that work out to, $.54/point. She kept their charges just below the $1500.00 threshold so Disney wouldn't put the charges through until after they left, knew just what to do. What a deal, what a scam.....

Have you considered taking her on one of the Judge shows like Judge Judy?? I so would but you do have to watch you small claims limitations

A great way would be to send her a singing telegram to let her know she skipped out on the $1400. :rotfl: I am not a DVC owner but find this sickening. When I checked out last week my credit card was charged immediately but I would never have considered skipping out on the bill. Had it been a mistake than the person should step up and accept it but it does not seem like a mistake.

I love this idea. Wouldn't it be great to have someone show up with tap dancing shoes, feathers in her hair, etc and sing out to everyone within earshot that the person was a deadbeat for $1400? :lmao:

I find it interesting that if you want use of a wheelchair at one of the Disney World Resort Hotels, a $315 "hold" is put on your credit card until the wheelchair is returned, but on the other hand they will happily give guests up to a $1500 line of credit without a "hold" put on the card at all. Anyone could cancel their credit card and skip out on their bill no matter which Disney resort they were staying at.

So Disney is worried about a $300 well used wheelchair being stolen but not $1500 worth of food and retail items?

Seems to open the door wide open for abuse/fraud across the board if you ask me. What kind of sense does this make?
