Rented points problem

Yes... thanks for explaining. As I stated in my earlier post, I have rented reservations for wonderful Dis owners. Since I give my CC # upon check in for charges, I had never thought to visit the front desk when checking out. I WILL now. I'd be mortified if the member received my charges to their account. :eek:

Indeed, I feel really awful for the OP. In a rental arrangement, both sides take on risk, and it's trust, understanding and honesty that makes the DIS DVC rental process work.
 
Just a tag for future updates and another voice of support for the OP. Also we have a legal system it isn't always a justice system and yes the police would consider this a civil matter at least where I work.
 
I really do find this " Whole" Situation very disturbing. If a" room only "reservation is booked from Disney, a deposit is made, the balance is paid at check in, then a $1500.00 limit is placed on the CC. Just had this happen to a family member. If the CC should have had a problem, What would Disney have done? There was a potential for at least $1500.00 loss plus balance of room, which could be in the thousands. How do they collect? I just can't believe they wait 6 months, then contact the customer. The only time you pay 45 days in advance is for a package.
FYI: When they checked in, the CC was already on file. I didn't think Disney kept this information on file. They went back down the night before and used their rewards card and let the balance go on the CC on file, they weren't even sure which card was on file. LOL.
 

I never charge to the room. For me, it is much easier to just use that card myself for dining, shopping, etc. and pay as each transaction is done. I also tell family members that if they are on the DDP, not to give a cc for charging to the room. That way, they always know that their meal was billed to the DDP, and not to their cc on file for charging purposes.

For some, it might seem easier to charge to the room. For me, it's not worth whatever extra hassle I would have checking out, or correcting any problems.

A few years ago, we rented points to people we didn't know, and then worried that there wouldn't be any problems. We've been lucky the past 3 yrs, that enough extended family members have wanted to rent from us.

They'd have pocketed the 80% margin they make on room nights off the CRO room only reservation (that charge goes through when the balance is paid - at check in at the latest - and I think Disney is making you pay the balance before check in now - , and at that point if the debt is bad, the responsibility moves to the credit card company - the room charge just takes a "is this open" hit, the charge doesn't go through until check out), and written off the charges as bad debt - coming out ahead profit wise. But here they have no profit on the room reservation and no reason to write off the bad debt since the member is responsible for "acts of omission."
 
The OP has already stated that this rental was not done thru the DIS Rent/Trade Board.
so does everyone feel that being on the disboard makes a difference? how common is this situation?
i'm asking because i am renting my points and have made a resv to a person from the disboards who seems to have longterm legit activity associated with her user name. i'm very scared that i could end up footing a large bill and have already decided not to rent again. is there anyway the dvc owner can protect themselves besides a rental agreement?

I am starting to get very concerned with this. I have rented many times and have not had a problem, but now I wonder...
 
I agree with Debbie B that the agreement is between Disney and the cardholder and even though we are ultimately the owners of the timeshare, Disney is responsible for management, upkeep and oversight. I think if you challenged that legally, you would not have to pay the $1400.

I agree that Disney can't make the owner pay the bill. But DVC is not asking the owner to do that. They are simply putting a hold on the DVC owners account, since they own the reservation and are responsible for the action of their guests, until they get the guests to satisfy the bill with Disney.

And we - each of us members - agreed that they could do that when we signed a contract saying we were responsible for acts of omission by our guests.

The percentage of things going wrong is very small. The percentage that something could go wrong is very high. There is no way to really prevent, retal agreements are more about making sure everyone is one the same page, not to protect anyone.

The only way to be 100% safe is not to do it.
 
Although we may be responsible as the owners, I do not see how we can be made to pay for something we did not sign for or something that was charged on a credit card that does not belong to us....Maybe it depends on what the charges were for....room service would be attached to the room possibly...sounds lige a legal question
 
It doesn't matter if your signature was on the credit slip or not. Your signature is on the ownership agreement that makes you responsible for omissions by you or your guests staying on your points.
 
The OP hasn't updated the thread in almost a month. Maybe the situation was resolved amicably?

I think that's a credit to the members on this forum that very few things do go wrong.
 
I am very confused by this whole conversation, I have rented points more times then I can count, living In FL we have gone anywhere for 1-3 times a month every month. The reservation is in my name and I give a credit card upon checkin and any charges are put on my credit card. I have never had any issues and never expected to. I don't know how Disney would allow people to charge if their credit card expired or they should have noticed the expiration date at checkin and asked for another form of payment. Likewise this highly unusual situation the DVC owner should send a certified letter to whom they rented to and threaten leagl action. Any DVC owner would have the address and phone numbers of rentors since they give it for the reservation. File small claims, whatever. Disney should have a policy that if a credit card is about to expire they need another form of pymt. I handle vacation rental homes and we always keep a credit card on file, if it is about to expire they must have a new one or they don't check in.
 
No one said the CC was about to expire or expired. You could check-in with a valid CC, walk into your room, call the CC company and have it cancelled and no one would know the difference. As long as you don't reach the charging limit ($1500 @ deluxe), you could be gone before they charge your card at check-out.
 
Last December I rented out some points and just now I'm finding out that the renter had left with a $1400.00 charge that wasn't paid. I had her sign a rental agreement. Can DVC hold me responsible for this? I thought guests had to supply a charge card at check in to set up charging privileges? Why would I be responsible? Any help/advice would be appreciated.

Several people have asked for an update on this. I have filed a small claims action and am waiting for a response from the renter. Very limited on what I can do to collect this. Hopefully I can collect after a judgement is rendered. I will update this when I have more info.

I did have to pay DVC so I could use my points, there was no way around it.

I'm sorry it didn't get resolved more easily - apparently your renter is a jerk of the first order. I hope you eventually get your money back.
 
I am so sorry this happened. Anychance of calling the school paper and get them on her? Or a local consumer action reporter either in TN or MA???
