They are already going to eliminate plastic straws.
 
I know it is legal and had no problem with the DSAs. It is also legal for Disney to have the only smoking areas outside of the parks.

And I was rolling my eyes at your quote about how much you would pay your lawyer. Seems like you only wanted to toss out how much money you could spend on a lawyer over a case they would lose anyway.


My first mentor at my first law firm used to say his favorite clients were those who were rich, righteous and wrong. :-)
 
I truly understand how much this change is affecting smokers. It sucks for the smokers. You are angry and resentful. But the truth of the matter is that life is not constant.

Things change. Sometimes it is an external decision like Disney's decision on no smoking in the parks. Other times it is a life change - like something that happens to you and your nearest and dearest. But the constant is that it is usually something that you have NO control over.

There are people who have trips planned that are disrupted by a spouse that decides to leave the family or a death in the family. Or God forbid a child who has serious health issues.

My Disney experience has been affected by a degenerative nerve disease. There are several rides that I will NEVER be able to ride again. I could *&^^%&$#@ and moan. It is not my fault on any level - but I have to live with it. Just as the smokers have to learn to live with the new reality. Not saying you have to like it. But you do have to live with it.
 

Well... spent hours planning my trip from May 13-18, then found out about their new non smoking policies, I get it Disney can do whatever they wish in their parks and I can do the same with my cash(10K). called them up cancelled my grand Floridian reservation along all my restaurant bookings. They tried to give me a hard time about their non refundable park ticket and Disney after hours ticket policies (had those too) and that didn't go very far once I told them they would deal with my lawyers.

Of course they tried to give you a hard time, you are breaking the terms that you agreed to at the time you purchased both sets of tickets.

You are being very condescending and it is uncalled for. The fact remains smoking is legal remember that!

Smoking is legal yes, but they have the right to decide where or if it is allowed on their property, just like they do with plenty of other legal items like selfie sticks and alcohol.

All that is illegal, called trespassing you might even get shot...careful smoking is LEGAL.
And I am sure that Disney could trespass you for repeatedly breaking their rules as well.

Sorry but I don't play with people, you are entitled to your opinion as am I. It is a public forum and I expressed my Disney experience, if it doesn't suit your narrative you can just move on.

I am questioning the legality of Disney imposing restrictions on smoking in their parks nothing more and nothing less, if trolls come into my open minded discussions I will obviously rebut.

What legal precedent do you believe protects your "right" to smoke on someone else's private property?
 
I have contacted WDW both by phone and email regarding banning cigarettes in the park and both times was told that they will allow you to carry them but that you must leave the park to smoke. If they have a DSA outside the park smokers will need to carry cigarettes with them to utilize the DSA. Why does everyone think you are banned from carrying them into the park? Luckily for me my kids are 19 and 17 so I can make the hike outside the park to smoke, but this change will likely impact whether Disney is my 1st choice for vacations after my trip this summer.
 
As a smoker I have always went to the smoking areas but did find non smokers sitting in the middle of the area complaining about smoke. I found these areas out of the way which was fine by me. Having to go out of the park seems a bit much. Also why not ban in France or Japan. is Disneys caring for its customers only extend if they dont lose money. These two countries have a lot more smokers, if they stopped going profits go down. Should policy not be for all of Disney or none.
 
Everyone doesn't think that. I'm not sure why you think that.
I have seen numerous posts regarding having to keep cigarettes in their car or at the resort as Disney will not allow them to bring them into the park.

Different countries, different cultures, different standards. It would be ridiculous to try and run a business in Japan the same exact way it is run in the USA. And Disney is first and foremost a business.
 
Funny thing. A quick look of marlboroman's profile shows he is from Montreal. A place where smoking is banned in many places, including on outside terraces and patios. Not to mention campgrounds, sports fields, playgrounds. And he would try and sue Disney?????

Smoking rates are also dropping in asia, especially Japan.

Ever smoked? Ever had the urge to smoke? Its not just a "I want a cigarette" like "I want a brownie". Its an addiction. One of the strongest that there is. And for some their anxiety can get out of control from not having a smoke.

Disney isn't going to miss me or my family. Its ok. We will go back. We just won't stay there or eat all our meals there. We will go to Orlando, split our time with the other parks or whatever and it will be ok.

There are wonderful substitutes out there, other ways to get the nicotine rush or wean off of it. My father, a lifelong smoker (and alcoholic) went cold turkey for the alcohol and used a patch to wean off of nicotine before he got some huge basal carcinomas removed. Sadly, he had smoked for so long that he had already done the damage to his lungs, and died a few years later from lung cancer. But it a man in his 70's can quit a life long habit, then I'm guessing other people can to, if they have the courage and guts to try it.

That is my choice... I don’t to expose you to anything and won’t. Just the vehemence towards the people that do is frankly appalling. We are human too.

Secondhand smoke, the costs of treating diseases caused by smoking (which costs are spread to all who pay for insurance) and the fact that most of the pollution found at the beach is made of cigarette butts - three reasons why people hate smoking, and don't really think too fondly of the people who smoke. There are many options out there to quit smoking. Most workplaces and health insurance actually cover some, if not all, of the costs.

But don’t assume that someone younger than your dad either doesn’t have the guts, the courage or the motivation. It’s not the same for everyone. I would never assume that one heroin addict can “just quit” because another was able to and never look back.

Those posts were all hypothetical— IF Disney decided later to not allow you to bring them into the parks. That is not what the policy currently is.

Many have been discussing that people will likely resort to smoking in the restrooms or other prohibited locations. If that happens, the solution proposed would be to ban people from carrying cigarettes into the park at all.

I quit smoking in my 20s, cold turkey. Your comparison of smokers to heroin addicts is quite frankly appalling. Any person that puts others in danger through second hand smoke is an entitled person and I for one, will be glad they quit going to Disney,
 
Truly I don't believe there will be increase in people smoking in the parks. The people who broke the rules before will continue to do so, those that followed the rules will also continue to do so. I do think security will be more painful. Assuming average MK capacity of 65k and only 10% of the visitors are smokers that means 6500 people entering and exiting multiple times a day and alot of them with bags. Last year I did not see anyone smoking cigarettes outside the DSA. I did occasionally see billowing clouds of smoke which I assume was from someone vaping.
 
I also never smoked in my life, lost a grandfather to smoking and yet I too think this is a bad idea and will lead to problems. Yes, the smoking areas could have been better set up and better enforced, that's definitely true, but I think that is still a better alternative than banning smoking from the parks entirely. People go to the parks for 10-12 hours a day, and some places have a LONG distance to the front of the park (Although I would guess maybe for Epcot they'll have an option on the international gateway?)

I feel sorry for the CM's who now have a lot more rules they're supposed to contend with. People will probably try to smoke on the monorails or the gondolas on their way to the parks now :sad2:


This is how I feel as well. I have never smoked a cigarette in my life. My grandparents smoked and my grandfather died of emphysema. I really dislike smoking and hate to be around it.

Yet... I really feel for the smokers and completely understand their reluctance to visit Disney now. I really don't want to walk through clouds of cigarette smoke, but I have no problem with DSAs that are located out of the way. It sounds like some of them were badly located, but if they are truly tucked out of the way, I can't imagine why it would bother me (as a non-smoker) that they are there. Of course, Disney can do whatever they want, but I really do feel for the smokers in this situation. I also understand why the short notice is so upsetting to people. I do think that it is really unfair of Disney to change this policy with such a short notice. Sure, they are within their right to do so, but I think a six-month notice would have been better.

I do think that this policy will likely result in people smoking in places where I am more likely to encounter it. The DSAs seem like they were the appropriate solution to this and the CM's should have enforced rule-breakers better.
