No more smoking or vaping in the parks

All that is illegal, called trespassing you might even get shot...careful smoking is LEGAL.

Hunting with a license is legal. Playing music is legal.

Trespassing is illegal. As in you do something against Disney's rules on their private property and get asked to leave. Then you are trespassing if you don't.

Smoking is legal, drinking is legal, hunting is legal, playing music is legal. Property owners have the right to not allow it on their property.

At this point, I believe you are just playing with people on this thread.

Sorry but I don't play with people, you are entitled to your opinion as am I. It is a public forum and I expressed my Disney experience, if it doesn't suit your narrative you can just move on.

I am questioning the legality of Disney imposing restrictions on smoking in their parks nothing more and nothing less, if trolls come into my open minded discussions I will obviously rebut.
 
Not sure its a slam dunk... parks are outside, not for Disney nor me to decide if one can be restricted from smoking exterior only a Judge can decide that.
Nope, not how it works. Their property, their rules. PERIOD.

How do you explain NFL stadiums then that are not covered? All of them are smoke free in the seating area and 99% of them do not have DSAs within the stadium. Their DSAs are outside the stadium and most have a no return policy. So, if you leave to go smoke, you cannot return to the stadium to watch the rest of the game.

The seating areas are outside on non-covered stadiums, yet it is perfectly legal for the team to ban smoking in the seats.

It is private property. There are no amendments in the constitution or anywhere that grant the right to smoke on private property to smokers. Private owners can dictate what is done on their property.

Your lawyers would have lost and you would have been out $100,000 trying to prove a point. Luckily for you, Disney knew the cancelling of your vacation had no impact to their bottom line so refunded your money without you having to spend $100,000.

I can answer that for you. They can impose restrictions as they have been doing for years. What they have done is move the smoking locations.
 
I am so glad they're getting rid of smoking. Where I live you can't smoke near children's parks, in cars with kids, close to businesses or under awnings so when I accidentally walked through smoking sections it was really shocking to us that it was allowed in a place like disney, to begin with, like you can't buy gum but can smoke? lol
 
Lol his name is marlbororman guys don't feed the troll if he's stooped to trolling disney forums he clearly has a rough enough life. And if he's authentically this upset about not smoking its better we don't have to deal with him in the parks

What is the purpose of your post except to beat your chest and claim that you know better than everybody else? Nobody really cares and nobody here makes or enforces the rules. And nobody cares whether you go to WDW or not. Some might actually be happy that a person with such a chip on their shoulder is not there. And as someone with a very few posts (mostly on this thread) you have no vested interested here.

You might want to check out Laws here in Fl. Disney is well within their rights to not only ban smoking in the parks they can ban it on their entire property if they want. Good ,stay home and enjoy your smokes while you can still breathe.
 
Sigh! I miss the Marlboro Man! You know, the one on the billboards that would magically get a raincoat/duster on rainy days. Even as an adult, I thought that was cool...

Hundreds of thousands of smokers visit and enjoy both Disney parks in the US each year, as well as Millions of drinkers. I thought the boards were here to help each other out, not to criticize everyone that's not exactly like myself. Everybody has there problems. A possible solution for smoking can be fond on page 39, post 766
1 Disney makes money even after possible construction, one cast member at each location for maintenance and possibly collect money etc. If they charge to much for this it wouldn't work.
2 No irritation to other guests.

There are 4 of these facilities in each park in Japan, not charged for but a different culture.

You have no legal right to smoke on someone's private property if they have decided their property is a smoke free area. I own a business...it is smoke free (a farm. Which is entirely an outdoor space like WDW). I have asked people to leave who are smoking. They can stand in the street in front of my property if they like, but not anywhere on my property. Totes LEGAL.

They gave you back your money to make you go away...not because they feared your empty threat of a lawsuit (which you would have lost).

First of all, can you imagine the uproar if Disney tried to charge people to smoke? O.M.Goodness, there would be endless complaints like "I paid the same for my vacation" or justified complaints of Disney nickle and dime-ing just the smokers. Look at the uproar at just moving the free DSAs.

Second, Disney is not going to spend thousands and thousands of dollars building rooms with expensive air filtration systems to accommodate a very small percentage of their customers and then paying salary and benefits for staff to monitor and maintain. Far cheaper and easier to just ban smoking within the parks and tell people to head out the gates if they want to smoke.

Also, highly doubt they are going to take up valuable park space to create big smoking rooms. You cannot compare Japan to the US. There are completely different cultures. Disney is making business decisions based on US culture, not Japanese culture. Disney is making business decisions for the US parks based on customer response in the US, not the wants and needs of Japanese parks.

This is a business decision for Disney, not a judgement or criticism of an individual's addiction. They have determined, right or wrong, that it is better business to have a smoke free park in the US than to allow smoking in a designated area within park boundaries. Smoking is still allowed - for free. Just not as conveniently as before.

Regarding the legal rights Disney has, WDW has more than most, as they're semi-autonomous the way Florida allowed them to set up the Reedy Creek Improvement District (at the time, to allow the original city plan of EPCOT to be built). So it's not only the standard private property rights they have, but much more leeway they have beyond that.

Not 99%. Ten of the 32 have DSAs inside the gates. A few have DSAs outside the gates with no readmission ;).
 
I would think most of the smokers would actually welcome this change ... most of them want to quit and know what it's doing to their health, so by moving the smoking area out of the park, once they decide to try and quit, they will be less triggered during a Disney visit.
