Penalty phase...what will the jury decide? (1 day poll!)

  • Death

  • Life (judge will sentence within 60 days, LWOP or Parole in 25 years)

  • No unanimous decision...new penalty phase jury will be empaneled.


Results are only viewable after voting.
Duty called yesterday and last night so I was unable to check in.
To say I am disappointed would be a HUGE understatement.
I feel like we have all lived and breathed this trial for so long and most of us wanted the DP verdict....

I guess now we will have to find something else to do until July?

Maybe they did. Remember she was not under oath to tell the truth in her impact statement. She may have known none of that was going to be allowed in prison, but decided to say it anyway because it sounded good. The jurors who, like me, probably had no idea what the prison would allow or not allow.

I think someone said she could just wing what she wanted to say, there was nothing she couldn't say, unlike the others who had to have their statements approved. But I am not 100% on this.

JA has a mitigation specialist. Her mitigation specialist no doubt helped write the elocution statement JA read to the jury.

I doubt any of the programs JA listed were taken seriously by the jury. I think that the holdouts felt some compassion towards JA in some odd way. Maybe they thought the borderline personality disorder was a mitigation factor.

Also, a LWOP inmate in Arizona can work themselves up to Medium security prison. I have no idea if they have programs in Medium security. However, all reports I have seen say it is years before a Lifer can work themselves to Medium security. Her first 10 years or more will be very difficult. Do you really think she can walk a straight path to get to Medium security when the average inmate in Maximum security will be murderers and demented psychologically just like her? I certainly don't.

After watching the foreman on GMA, I am thinking he may have been one that voted for life. He said looking at JA it was hard to believe she was a murderer.


GMA:You did say you had a hard time believing she could be capable of, just looking at her, she could be capable of doing this.

BZ: Yeah, that's true. I mean, when I walked into the courtroom the first time and looked at who the defendant was. You know, its hard to put that into prospective. When you look at a young women and think of the crime and then you see the brutality of the crime, it just doesn't wash. So its very difficult to, umm to divest yourself from the personal, the emotional part of it.

ETA: Just looking at her size, it is hard for me to believe she moved the body. But I have seem mighty small women take on some pretty big horses and win the battle. So size isn't everything!

What are your thoughts on how Judge Stephens took this verdict? :confused:

I think Judge Stephens was disappointed. She wanted a definitive verdict, since the trial has been going on so long. But she realized that the jurists had exhausted all of their energy and could not proceed further.

I personally have no inclination of a verdict of Death or LWOP for JA. I only hope that she does not get Life with the possibility of parole. She is a dangerous person left out in society. Death would be more expedient, but living in a prison until your dying day is probably just as tormenting.

I have to think if the jurists who held out for Life did so because they sort of bonded with JA, then a second jury would not have that dilemma. The defense strategy would have to change. They would have to present a stronger case for mitigation because you know the prosecution would showcase the very harsh way Travis Alexander died with photos. A second jury may not be as merciful with JA with those photos.
 
As much as I say that I won't follow into the new trial, I'd be kidding myself. Plus I really like most people on this thread and enjoy the daily talks.

An esp cute song called "goo goo ga ga"...something about the DIS reminded me of this today and now I've got it in my head! And Raffi! There are probably all sorts of new CDs out the now there! Loved those days! :)

I live in the county in NJ where they had the Suit Case Murder.

Melanie McGuire, a 34-year-old nurse and mother of 2, murdered her husband William McGuire in 2004. She claimed that her husband Bill was a gambler and he had owed money to organized crime guys, which was never substantiated.

Jodi Arias reminds me of Melanie McGuire, who had a very cool and collective demeanor. She worked in a fertility specialist office and was cited for her compassion as a nurse in helping couples deal with their fertility problems.

McGuire was out on $750,000 bail up until her first degree murder conviction and could be watched walking the streets before each trial day.

Her husband's body was found in 3 separate suit cases, which washed ashore or were floating in the Chesapeake Bay off of Virginia. The most important evidence were weights that she put in the suit cases that matched weights found in her apartment. They also found her apartment cleaned with bleach, faked Xanax prescriptions that were used to drug her husband.

Melanie McGuire was sentence to more than 65 years in prison in 2007. She would be eligible for parole when she is 100. She, like JA, was considered to be an attractive and manipulative female.

There was speculation whether she would be convicted. I remember reading the case against her was not fully closed because there was speculation that she received help from her parents in disposing the body (by throwing it from the highway into the Bay). So far they have not filed any complaints against her parents. Her husband's family are raising her boys.

Just wanted to pop in to say thanks to all of you for your insight and commentary during the trial. I couldn't watch the live feeds, but would catch up on HLN at night while reading your responses on my laptop!

I was pretty sure it was going to end up a hung jury. I even voted for it on this thread! I come from a state which does not have the death penalty. For the most part I am not in favor of it, but might see it for extreme cases.

I have always thought that Jody has a serious mental illness. She actually reminds me very much of a cousin of mine. We were raised together as kids and she was pretty normal then. Her family had some major trauma when she was in her early teens and in my opinion she suffered serious neglect for several years. As a young adult, she was very narcissistic. She was (well, still is) the center of the world and everyone else are just actors in her play. Other people have no autonomy, just exist to do what she thinks they should do. She tells massive lies and truly believes them. She feels no remorse when confronted with her lies or the fact that she has hurt people. Anyway......reminds me a LOT of Jodi. In the case of my cousin, I cut her out of my life years ago for my own sanity. I do hear about her from other relatives, however, and she has not changed over the years. And....clearly I have some unresolved issues regarding her.

Given that I believe Jody probably suffers from mental illness, it would be very hard to vote for the death penalty for her. However, if I was on the jury for a person who shot three random people during a bank robbery and then killed a cop on the way out.....I think I could vote for the death penalty.

That aside, my heart breaks for the Alexander family. I don't see how they can go through this again. I think Juan Martinez did a great job. I think the Judge did the best she could. I think the Defense Team was in way over their heads and were just irritating. I also think a mental illness defense was obvious! I don't blame the jury at all. They served us well. In my opinion, the American justice system worked even with all its flaws.

AND congrats to Pigletgirl and her little family! I would love to see a pic!

well, back to the hospital for a lab draw. C is a bit jaundiced. want to make sure everything is ok. she will have her first dr visit on tuesday.

I know there will be a new jury, but how are they picked? Do they just get asked "can you give the DP?" I have never heard of this before...

And then, do the teams get to give their statements just like before? will the Alexander family have to do VIS again???

They'll pick from a jury pool, attorneys will inquire as to thoughts about the DP and yes, the Alexanders can testify again. This next phase will be a little more detailed than the last since this new jury supposedly won't be influenced by anything they may have previously seen.

I'll keep up with it too since July can be damn hot in Texas making leaving the house undesirable. Course, August is worse and I'll be surprised if they start by August.

If Willmott continues with this case or even another attorney, they should request the court not allow cameras in an effort to minimize the lynch mobs, although on the other hand, it does allow someone to watch the trial versus the talking heads, money grubbers' version of what went down in the court room.
