  • Life (judge will sentence within 60 days, LWOP or Parole in 25 years)

  • No unanimous decision...new penalty phase jury will be empaneled.

I kept re-watching the verdict, over and over. I noticed Jodi always looking at certain juror. I noticed it during the trial too. I wondered if she connected with this juror.
I noticed this as well. She seemed to stare in a particular direction; I couldn't tell if it was at one or more jurors. I wondered if this was why she exuded such confidence at times. (Well, that and then there's her total disconnect from reality):crazy: Evidently she got to more than one.:worried:

I suspect that the mitigation penalty phase is extremely subjective to each person. What you would consider proper mitigation for allowing Jodi Arias to live would not be the same as another person. I don't think 4 jurors decided they couldn't sentence JA to death. Rather, they each found some mitigation factor that the others did not agree were enough of a mitigation factor to allow JA a life sentence. I think that each side tried their best to come to agreement but couldn't.

As non-jurors, it's much easier to make a up or down vote based on the feelings of your knowledge of the case. But these jurors had to go through each mitigation factor presented to them by the defense and either say it was a worthy mitigation factor or not. 4 found some mitigation. 8 did not.

I agree. There were four jurors that found mitigating factors. This is our justice system at work, it may not be perfect, but it worked the way it was suppose to work.
 
My post is not about mitigation factors. Pebbles was talking about religion and personal beliefs like those were ok reasons for someone to not give death in this phase. Both should be a non-factor because this entire jury was asked and if they could give death before the trial and they said yes, meaning if that was not the case because of their religion or personal beliefs they should have NEVER checked yes to that question or been on the jury.

At the least that person could asked off the case before this trial got to this phase if that was the case knowing full well they could not fairly judge life vs death because they could not give Death because of their own religion or personal beliefs.

You do not know the reason why the 4 jurists who voted against death did so. So why are you assuming they were against the death penalty? Maybe they found a mitigating circumstance?

Just because you or anyone else who views the trial thinks there are no mitigating circumstances doesn't mean someone on the jury doesn't.

I mentioned this to Jen last night that this jury was as I think Mare said "older leaning" and I tend to think older people believe younger people can be rehabilitated as we older people may look back on our lives with some regrets in some areas and maybe that played a factor in this verdict for some jurors. I wax and wane (like the moon, lol) on that kinda thing, think prison should be a punishment versus rehabilitation, hope that my teenager realizes when he gets older that I never believed any of his excuses for bad behavior and most times now realize with some crap in life "ain't nobody got time for that."

Not sure what to think of that Youtube usnuz posted from the AZ Deputy Warden wanting Jodi to know prisoners die while in the custody of DOC due to the negligence of their corrections officers. And did he really say life in prison is cruel and unusual punishment? :scared:

Throughout this trial, I've been trying to get a sense of the judges thoughts. At times she seems annoyed or tired, but other than that, no real emotion. Yesterday she was visibly upset and took quite a pause to regain composure. I think she was very saddened for the family that this didn't end, and also saddened that the jury wasn't able to come to agreement. But there was also frustration that this isn't the end. Because of her emotions yesterday, I'm willing to bet that if this new jury is also hung, she will choose life without parole (as she most likely would have done with this jury). I wonder if the Alexander family may just decide to call it a day and take death off the table. Not sure if they can decide right away or if they have to wait until the June date?

As much as I say that I won't follow into the new trial, I'd be kidding myself. Plus I really like most people on this thread and enjoy the daily talks.

UR, yes I believe that prison life will take it's toll on her. I don't believe in any abuse by the guards ever. If they are doing that then they need to be let go. I have many friends who are correctional officers at a womens prison. One of the men made the transfer from a male to the women, he said that was the biggest mistake of his life. He said they are worse than the men. I have heard allot of stories from them. Jodi is in for a wake up call. But have fun on vacation. I have a little while before ours arrives.;)

I can't for the life of me figure out why Jodi's family went to visit the GC yesterday. They knew they were waiting on a verdict. Strange if you ask me. I need to get out and get some fresh air today.

I think this is up to the prosecution. I think they may continue to follow through. Once they pick a new jury it wont take that long. I forgot who said it , but it may take a few weeks to take go through the stuff with the new jury for this phase. Who knows it may have a different out come. I would love to hear JSSs' thoughts on this at some point. She may want to retire after this. :lmao: She is probably thinking what did I get myself into.:lmao:

I have a feeling that a new trial probably won't even start until NEXT July ... I suspect that Nurmi and Willie will ask to be removed from the case again ... I don't know if the Judge will grant their motion, but if she doesn't, I bet they will then take it to a higher court (especially if they are adamant about be taking off) - which will cause a delay ...

Then, maybe, if the DT doesn't get their way of being removed, they will decide to ask for the Judge to be recused from the case (wouldn't put anything past them) because she showed emotion on the stand and they will claim that now she can't perform her duties properly because she is bias or too emotional or something like that - so another delay ...

But, however, if the DT does get taken off the case, JA has to find herself a new lawyer - another huge delay to get new lawyers and get them up to speed with the case ...

Then, I'm sure the new (or old) DT will ask for a venue change citing that they can't find a fair jury in Marciopa County ... delay

Then, of course, JA will throw a few of her migraines in the mix here and there ;) and court dates will have to be postposed, rescheduled, continued, etc. - delay, delay, delay ...

Of course, I'm just speculating on all of this ... But I think JA will try everything in her power to delay and avoid checking into the State Prison any time soon ...

I'm starting to think that maybe the Prosecution should strongly consider offering JA a plea deal for LWOP with stipulations that TA's family can find justice, peace and closure with (i.e., no media interviews ever, no appeals, no contact with the family, gag order, etc.) ... Of course, I don't know if this is even possible to do, but it's just a thought ...
 
I wonder why the defense attorney's didn't tell Jodi that she won't be able to start the "programs" in jail? They should have given her truth about how brutal jail really is.

But on a much lighter note. Piglet soo enjoy that new baby. Take lots of pictures because they chance so quickly. Something I saw that I wished I had done. Take a picture of Charlotte with a certain stuffed animal every week so you can see her growth.

Also I'm wishing everyone here a healthy, happy and free memorial day weekend. Remember we are all free to chose to do whatever we want. Enjoy family time. I know I'm looking forward to seeing my grandbabies and remembering my dad who was in wwii.

Thanks to everyone on this thread in giving me a home to share this experience. Something good came out of a tragedy. We found new friends!!!!
 
Well not only excitement in Arizona, We just had a 5.7 earthquake here, which is rare. No damage, I am so used to them.

We felt it here too. I guess it was centered near Lake Almanor? Funny how growing up here we never felt any quakes, but I've felt 4 of them in just the last year. Maybe the "big one" IS coming! :scared:

I was just coming on here to comment about the absence of Jodi's family yesterday when I saw they went to the Grand Canyon for the day. Wow, again, just Wow!

First of all, I can't understand why none of them stood up for her. And second, why the hell would they leave when they knew a decision could come at anytime. It really gives the impression that they don't care for her at all. Did the mom really not want to be there if they sentenced her to death? Was that something she really wanted to hear on the car radio?

Wow. Again, speaks volumes of that family.

You are right they are not telling Jodi what will happen in a prison. How does she think she will make a shirt? That video from the person that is talking about prison is spot on. She is going to age faster than she could imagine. I feel the same way, I have made new friends here along this difficult journey. :yay:

I didn't know you lived where I am. I live toward the Natomas side. They said Susanville. I am so used to them. I am used to the 6 and above. Did you have any damage? None here.

Maybe they did. Remember she was not under oath to tell the truth in her impact statement. She may have known none of that was going to be allowed in prison, but decided to say it anyway because it sounded good. The jurors who, like me, probably had no idea what the prison would allow or not allow.

I think someone said she could just wing what she wanted to say, there was nothing she couldn't say, unlike the others who had to have their statements approved. But I am not 100% on this.
