Penalty phase...what will the jury decide? (1 day poll!)

  • Death

  • Life (judge will sentence within 60 days, LWOP or Parole in 25 years)

  • No unanimous decision...new penalty phase jury will be empaneled.

I might be wrong, but i believe it will be death or hung. CMJA might have pulled the wool over some of the jurors eyes, but not all of them; I hope tey hold out. i know it would be hard, but im sick of her arrogance. I think i would rather a hung and have to go through it again, then to see the smart smirk of "i won" on her face if they were to read "life." She disgusts me!!!

I'm asking because if one are more jurors feel they don't want to be responsible for "killing" her, why doesn't someone stress that there will be an appeal, so the "killing" will actually be the appeal jury's decision. Unless there's no appeal??

#JodiArias court PIO says we have an hour for lunch because judge has a mtg. Unclear whether jury working through but nothing new until then

Yes, there's an automatic appeal process and I'd definitely use that argument.

Yes, there is. And I was thinking the same thing. Ultimately, there is so much that happens between sentencing her to death, and an actual execution, that I would feel that I may start the process by sentencing her to death, but after that, the law takes over...appeals, maybe the governor, Jodi actually becoming an incredible human being worth saving (doubt it, and look at Karla Faye Tucker), rather than just listing her fab plans in her allocution, and an appeal process considering that.

So much for me being productive. Let's try this again! (I did throw some laundry in. :blush: )

I am trying to accept that the outcome may not be what I feel is just. I am afraid to have the same feelings I had with CA trial. Makes me doubt our system, our society. I am praying for peace for Travis's family is the biggest thing.

I am afraid of how damn smug that cray cray CMJA will be if she gets what she thinks is her way.

At least we are a step ahead here compared to the CA trial. There was a guilty verdict so even if they give her LWOP she isn't going to walk away like Casey did.

I just hope if they don't do the death penalty they go with LWOP and not just life...I'd hate to think she could get out on parole since she plans on being such a good person helping others. :rolleyes:

If the jury chooses Life, the judge sets a sentencing date and she sentences Jodi to LWOP or Life with possibility of parole in 25 years.
 
The one thing I agree with Jean C, can't believe it, but she said what I said they said they could vote for the DP, and if they can't that means they lied and purjured themselves.

If they said they could but knew that they could NOT, then they purjured themselves. If they said they could but feel, as jurors of this case and knowing what they know (not what WE know), that this is not a case that warrants the death penalty, then that doesn't mean they've perjured themselves.

This phase wouldn't even exist if it was that simple. They would take the guilty verdict, and the especially cruel decision, and the death penalty would be automatic. The first two phases are more fact-based. The mitigation phase is murky and the jurors each have their own opinions about what constitutes a good reason to spare someone's life.

Meanwhile, DH is going to pick out flowers for the garden without me. :eek: I gave him some guidelines. Let's see what we end up with.
