I desperately need advice....

Gigi is at the vets now getting spayed. She also needed two baby teeth pulled out because they had not fallen yet. Poor baby, I could tell she was nervous but it's best for her.

In regards to ex-co-worker, here is her email from this morning:

"I have been trying to contact you and you have not responded to any of my emails or text. I hope that everything is okay with you and your family. Ever since I told you that I wanted Gigi back, you have been avoiding me. I would really hope that you are not trying to avoid me so that you can keep her... doesn't seem like something you would do.. besides.. I would let you see her like I thought you would let me do.... I hope your new year's was good. take care"

God...I really don't know what to do:guilty:

Tell her that the dog needed treatment and care,something she didn't give the dog you will be keeping her safe from her ex owner and tell her to stop bothering you. You did the right thing keeping the dog safe and should keep doing it, don't feel guilty for looking after an animal who needs you. I took a couple of cats from a co workers sister because she was starving them to death they both lived long happy lives away from an idiot.

I'm going to take this piece by piece and make it simple so that everyone understands. EX-COWORKER! You are an irresponsible pet owner! IRRESPONSIBLE! OUTRAGEOUS and IRRESPONSIBLE! You gave this dog away! You should be thankful your ex-coworker took the dog in and gave her a good home instead of sueing her. When you give a dog away, it means just that! THE DOG DOESN'T BELONG TO YOU ANYMORE! PERIOD! Doesn't. Belong. To. You. Anymore.

Oh, yes, Madam, you are irresponsible and I"m going to tell you why! You moved to an apartment that didn't accept pets. A responsible pet owner who loves their pet doesn't do that! If you can't move to where your pet can go too then you PAY someone to keep the dog for you! YOU DON'T GIVE IT AWAY THEN EXPECT IT BACK because THAT IS WHAT A USER DOES! So in my book you are irresponsible and a user. :::shrugs shoulders and purses lips ::::

WDWFun, I'm addressing you now. You've taken very good care of this dog while she has been in your care. You've taken Gigi to the vet, had her groomed, her vaccinations are current, she'd been spayed - all things that a responsible pet owner does. I'm glad you have been so kind to this pet because I'm a maltese owner myself. I have a special place in my heart for these cute little dogs. ::: smiles warmly at WDWFun :::

However, all that is irrelevant. It is only relevant that your ex-coworker gave you the dog. Gigi is yours now to do what you wish. She is a member of your family because she was given to you and you accepted her.

WDWFun, now to your counterclaim. I'm dismissing it. That wasn't the agreement that the two of you had. Your agreement was that you would take the dog because she was giving it to you. You can't ask for pet sitting fees now just because she wants the dog back. Even if I wasn't ruling in your favor to keep the dog, all I could order her to re-pay would be the vet bills, grooming, and dog food costs that you shelled out.

I'm very glad you kept those emails between the two of you, WDWFun. Without those I would have had a hard time determining who the dog belongs to now. I wish Gigi a long and happy life with your family.

Something else that may be worth looking into - maybe find out what local laws consider to be neglect or abuse. I'm wondering if the fact that she has had no veterinary care for this animal would be considered neglect by your local laws. A dog doesn't have to be starving or beaten to be neglected and abused. I believe, in most cases, not providing for ALL of the needs of the animal is considered neglect - and veterinary care, shots, an all that basic "upkeep" are needs of any animal.

Great point Beth! And getting a license will create more of a paperwork trail.
 
Just wanted to point out that I don't know where she has moved to, so I have no way of verifying if they do indeed allow pets. She just told me that dogs were not allowed, only cats.
What she says now is that her "neighbor" told her that as long as the dog is quiet, a deposit would not be required and she can have a dog.

Gigi has had everything done, her shots are updated, license tag registered to my name, microchip and she is still at the vets now as she is being spayed.

Which means, if I had to guess, that if the management does not KNOW that she has a dog, then it's "allowed." Both of my DDs live in apartment complexes which allow pets. But everything regarding it is printed the lease - deposit (always required), pet rent, size requirements, etc. I am sure that there is nothing in this woman's lease about no deposit being required for "quiet" dogs. :rolleyes:

Totally agree. You don't leave pet deposits in case of loud dogs. You leave them for messy dogs. And this sort of thing is ALWAYS in the lease. Her neighbor just told her if it's a quiet dog, the landlord will never know. That is until the landlord has to enter the apartment for some reason.

Tell her she GAVE YOU THE DOG and has no right to ask for her back and leave it at that.

First, my lovely Gigi is doing great. I just picked her up, she was a little drowsy but active. How cute that the vets gave me her baby teeths they pulled out, that was nice of them.

Well, I received a response. And I cannot believe what she says. I guess she is giving up?

"First of all,you should have never told me that I could have her back.. I gave her to you with the intentions that YOU said I could have her back... now you are going back on your words.. she is a very easy dog to love... and YOU told me that I could see her whenever I wanted.. lol.. childish of you not to answer my texts though... if that was the case you could have just told me. I am a firm believer that what goes around comes around... and for you to deny me the priviledge to have MY dog back is very low of you. I completely understand why you wouldn't want to give her back seeing as she is the cutest thing in this world you could have ever gotten for free. Thank you for the pictrues"

Funny how she switched around what I initially told her about being able to visit her into she could have her back when she wanted!:sad2:

I guess I'll get what's coming to me since what goes around comes around, though all I get from my beloved pets is love.:confused3

I guess I'm a rotten person because I received the cutest thing in the world for "Free."

As for the latest email, I'd be tempted to respond too, but I think I'd have to take the high road and ignore it. I'm not sure that anything you could say would make a difference anyway. She's going to twist words and do all she can to justify her actions over the past few weeks. It doesn't really matter what the truth is evidently.

Thankfully, what goes around does come around. You'll get yours in the form of wonderful blessings from your newest addition, and she'll get hers when someone does to her exactly what she's tried to do to you.

Don't respond.... She's a moron - not worth your time to entertain this any longer.

HOWEVER - Do not get rid of amy emails or text messages for at least the next few months. You never know when she'll pop up out of the woodwork again.

As for "free" - that was HER choice not yours. You just don't GIVE somebody something with the expectation that you can go back and get it whenever you like.
 
Keep all correspondence and don't reply. What would you say anyway? I'm glad she seems to have conceded. She obviously knows she's wrong and was hoping you wouldn't put up a fight. That leads me to believe she was looking to sell and/or breed Gigi. If she truly loved this dog she would be begging for her back. Not being sneaky and trying to manipulate the situation.

Definitely do *not* under any circumstances respond. Like MareQ said above - she gave you the dog, end of discussion.

When it comes down to it, she gave you the dog. Leave all the other stuff out. Nothing else matters (well, I mean it is good that you did all that). You don't have to defend your actions that you have taken since assuming ownership of the dog. Like Judge Judy said, it is irrellevant. She gave you the dog and that is your new mantra (the excowrker said it herself in this email you quoted!).

I'm giving you an assignment! Get out a piece of paper and write out 100 times the following line:

Gigi is my dog because she was given to me!
