How can you get out of a TA's reservation?

I am booked through an agency right now and the woman I've been dealing with is awful. She is now lying to me and telling me that I cannot cancel (I'm over 50 days out) and saying that my dining is connected to my reservation which I know it is not. She said the dining will be cancelled if I cancel my trip through her. She's refusing to cancel. What can I do?

How awful. I would call Disney and explain the situation. I have heard of cases where Disney will take over the reservation. It's worth a try.

I would also change your password on MDE and call Disney Dining and explain the situation and try to change your identifying information - different phone number, etc. - so she can't access your ADR's any more. You are correct - your ADR's are not tied to your resort reservation, but it sounds like she is going to cancel them out if you cancel. Awful, awful, awful.

You could also, as other PP's have suggested, try to get ADR's for the same restaurants and around the same times that you have now and then simply cancel out the ones she made for you. Then she can threaten all she wants and it won't matter.

I agree, I would write a letter to her informing her of your cancellation and even send it certified mail and write an e-mail. When you speak with Disney, ask them who, at the company, you can send a copy of this letter to. They need to know what's going on. Especially if she's with an EarMarked agency - Disney keeps a very close watch on them!

I'm really sorry you are going through this. What she is doing is completely unethical and just bad business.

And yes she could cancel your ADRs.

Not sure Disney could do anything.

She's not doing half of the things my first agent was. The service is bad. She takes days to answer my emails and now I'm feeling threatened. I really want out.
 
If you didn't pay anything to her yet, you should just tell her to cancel everything, and rebook everything (include your dining) on your own. Don't count on her keeping the dining ressie for you if you cancel the package.

It all depends on the agreement or contract between you and her. You can contact Disney for help. But I think it boils down to the agreement between you and the TA about pulling out, not the Disney cancellation policy.

If you are feeling threatened, something is very wrong. Knowledge is power. If there is anything you need to know to 'arm' yourself or any help you need in putting together a message to send, chances are there are at the very least, several people on these boards who could help you. If you want to do it by private message (which I would recommend with personal information) then just keep posting. I think you have almost enough posts to be able to start using your private messaging on here. You should not feel like this. A poster earlier on on this page has offered to help you wherever possible so just hit a short reply to a few folk here and you'll be all set :hug:

I agree that this is key. Although for peace of mind, it wont do any harm if the OP wants to speak with someone at Disney first, she is bound by the terms of the agent she used. The agent will be bound by different terms directly with Disney.

I was never made aware of any agreement if I cancelled. I thought Disney gave you until 45 days before a trip to cancel for a full refund. We paid everything for this trip. We were hoping to get a full refund because we're before the 45 days.

I originally booked with an another agent who did a great job but she was let go from this agency. The boss took us over and it's been a nightmare since.

YES! You most certainly CAN have Disney take your reservation over from the travel agent. I know...I just did this for My Sept 2013 trip. It is a newer Disney policy.

I started by emailing them the following info:
Name, reservation number, names on the reservation, address, phone and email. I included a very brief statement of my problems/concerns with the agent. Within 3 days, I was contacted by a cast member telling me that they also needed my signature on the note with the above info, which I sent the next day via fax. 8 days later, I received an email with the new confirmation info from Disney. DONE!

I made this change before my 180 day mark, so I did not have reservations yet. But, my agent was vindictive, and I was concerned that she would try to "get me back" by messing with my ressies. (The agent did this to my cousin, and really messed up her trip and caused her hours on the phone with Disney trying to fix things). So, when I made my ADRs, the cast member I spoke with flagged my account. It is a cause for concern because your agent only needs to know basic information on you to pull up all your reservations and make changes.

So, if I were you, I would explain your concern for your ADRs in your initial letter/email to Disney.

Lastly, just wondering *why* you want to cancel on this agent? Her way of handling your cancellation is not very professional. But, if she made your ADRs, she can cancel them too. Making them was part of her service to you.
Did you just leave because you found a better deal? Couldn't she find the same deal for you?

I hope everything works out for you. I also hope the agent doesn't mess with you. It's pretty crappy that some of the bad agents can get away with stuff, and still be in good standing with Disney. Thankfully, there are many, many good Disney agents out there too! :)

** edit to say that I was typing while you posted. If the agent left and you were reassigned to a *****, then I think Disney would be glad to take your reservation over for you! :)

Did she make your ADR's? If she did and you are cancelling your "contract" with her, I would expect her to cancel your dining reservations since you are cancelling her services (and making your ADRs were part of that service).
I'm not sure she can refuse to cancel your trip. I would check the terms you agreed too and contact someone else in the agency.

I'm not happy with the amount of time it's taking her to respond and the way she is avoiding answering questions of mine. I did find a better deal with a gift card deal that an agency is offering right now. Thank you for that information! You have all been SUPER helpful! I will get right on it!

What does flagging your account do? Will that prevent someone from messing with it? That's what I'm worried about most.

It can be very confusing. I'm going to do my best to explain it. A contract might not require you to sign. By allowing her to book your trip or any part thereof you have engaged into service with this agent. You may not have signed anything and I get that, if you have done it all online. To give you an example

I booked directly with Disney for my trip. I did it online and paid deposit only. In doing so and not canceling during any cooling off period that may be within their terms I have, by booking, entered into a contract of service /provision of a product with them. Every business should have an 'About Us' section which should have the company details, physical registered address and other information about them as well as terms of business. They may not be called these things in exactly the same words I have used by because you made a booking, you have entered into a contract. This however does NOT mean that you are not entitled to cancel and if they have vastly different cancellation terms to what is the regular norm, then they have an obligation to draw your attention to these. There should be something referring you there in your initial confirmation letter or email. If not, something is not right IMO. There are so many variations on contractual laws depending where you are but what she is doing sounds more than just a bit off to me and clearly to everyone else who has posted on the thread. I'm hoping you are getting some help via PM right now as I think you have enough posts.
 
Are you sure any of the reservations have actually been made? Have you received any confirmation of rooms or ADR's ? Confirmation numbers?
 
I haven't had the same experience but I can tell u I orginally booked my trip in August for the end of February. I went online and booked all my ADRs for those dates. Then in January about 50 days out we had to reschedule our trip to a little bit later. Before I canceled and rescheduled anything I went on MDE and redid my reservations. I wanted to make sure I could get the ones I wanted. I was able to book all of the ADRs except bog :( but I did manage to snag an ADR to trex which I couldn't get with my earlier dates so I was happy lol. If I were u I would sign up or log into MDE and try and redo your ADRs, that way the travel agent can't touch them if they are under MDE, at least that's what I hope would happen. Anyways good luck and let us know how this all turns out!
 
Some agencies have their own cancellation rules that are different from Disney. You should have gotten info on that though if it was the case.

I don't know what you do and don't have but it is pretty apparent that they have not done things properly. I don't see how they can hold you to anything, quite frankly. I would be so bold as to say they have many folk canceling as you are and that's contributing to their threats and hostility in attempting to intimidate you into keeping your reservation with them. Based on the information you have given us, I just can't see how they could possibly do anything to stop you from canceling. I think your biggest challenge is to have some faith in yourself and be direct with them and not allow them to intimidate you. :thumbsup2

When you go onto My Disney Experience with your log in info - is everything there? Resort reservations, Dining reservations, Fast Pass selections, park tickets/magic bands, magical express.. Etc. ?
 
I'm truly horrified reading this. I hope I am not breaking rules by admitting I am a TA. As a TA my clients could cancel as long as it was within Disney's policy. I have no rights to let them or not let them.

Now you could cancel resort/dining plan and your ADR's would be untouched. HOWEVER, others are right, if you gave her access to your MDE she could be vindictive. Here is what I would suggest if you want to make sure you keep those ADRs.

1)change email/password login-even if you need to create a new email just for the purpose.

2) This is going to be a PIA, but call dining. Explain the situation. See if you can give an alternate name, and be given a new reservation number. I am not sure they will allow this, but I would hope they would if you explain what is going on.

A good TA should be easily reachable, make you feel comfortable, and give you extra care that a Disney CM isn't able to such as:
-making ADRs
-scheduling Fastpasses
-going over day by day itineraries
-setting Magical Express

A TA should never be threatening, unreachable, or try to guilt you into anything.
