Guide won't sell diffrent use year

Just got off the phone with our guide and he said that there was no way he could sell us points at HH for a diffrent use year now I have heard that it was possible. What gives and if you have how did you get your guide to do it? He told me it was an agreement with the State of Florida?
 
Disney will not sell you a different use year. You can, however, buy a resale with a different use year if you find one that meets your needs.

Disney can only sell whatever use year they have available. We made sure when we were buying add on points that we didn't miss the same use year. Our guide called us when the March use year was getting down.

Hilton Head is in South Carolina. Florida should have nothing to do with it.

Disney's policy is to sell add-ons only for the same use year you have although if you are buying 150 or more points (and thus the amount of a new purchaser contract, they will usually let you go with another year). There is absolutely nothing involving Florida law that would require or even suggest that Disney could not sell you a different use year and there is no such agreement as the one mentioned. (Under timeshare laws, if such an agreement existed, it would have to be disclosed in the documents you get upon purchase, and no such agreement is mentioned in them.)

Giving the guide the benefit of the doubt, it may be an interpretation of what you are asking them to do. DVC will only sell add-ons with the same Use Year. They will sell you a new contract with a different Use Year. A new contract is currently 150 points or more. To sell you anything less than 150 points with a different Use Year could be interpreted as selling a new contract that was less than 150 points. This could possibly be against their agreement with the state of FL regarding what they are selling, i.e., new contracts of 150 or more points.

While HH is in South Carolina there may still be Florida laws that apply to Disney conducting business in Florida. This would be like the laws of the individual states that apply to us buyers....such as NY not permitting sales of BCV as quickly as other states.
 
Not certain if this is an add-on or not, Tripletvan didn't mention this in the first post.

I did a first-time purchase last week (BCV) and even though they were selling April use years at the time they gave me February after my guide left the room to "check" if it was OK. She said they were VERY reluctant to sell add-ons for a different use year unless you had a very compelling argument why you needed it. Not sure if HH rules are the same as FL rules though. Maybe that's what the guide meant...it was an agreement only with FL to sell use years by request (rather than the same one to any person on a first-come, first-serve basis). That might imply that you could get a HH contract for any use year if you went to FL!!

Since the "guides" are sales consultants, they would gladly sell you what they could. I am sure they are merely following the rules set by the DVC and the laws set by the States. :)
 
Yes, in February we booked a trip to FL for the week of April 27-May 4. I was gung-ho to buy in, but my wife wanted to see the place first. Had set up a "tour" for the 29th. Ended up working out great for us....since the $5/point incentive ended 2 days later.

I had been worried about being able to get a Feb. use year, but the helpful people on these boards reassured me they had been able to get a different use year from the one being offered at the time.

I guess I would suggest that tripletvan clarify what is being said about not being able to get another use year at HH. Is it only if you purchase at a WDW DVC that you can get a use year different than the one being offered? What if you're at HH or in FL...same rule applies? And ask stright-out, why can people buying at BCV chose their use year.
 
I never interpreted this thread as being about anything but an add on purchase, FWIW. Disney, if available, has always been willing to sell different use years than the "feature" use year (subject to being able to meet the banking requirements with that use year if one were desiring to sell points back under MB).
 
Doctor P, slightly off the beaten path here, but what are the banking requirements for sell back under MB? 50% perhaps?

In reference to this thread, the relevance of MB and use year is that under recent incarnations of MB you were able to sell back 50% or more of your current year's allocation of points. You need to be within your appropriate banking window to do this. In very rough terms, this means that Disney wants/needs you to buy a use year that begins within 6 months prior to your purchase date/estimated closing date (so when we bought in August 2000, they were nominally selling a March use year--we asked for a June use year, a request they readily granted).
