Getting into usa with a dui in uk? Moral tepitude

Hi, I got caught drink driving Friday. Holiday booked to Florida in sept. can I still do the esta waiver form or not? Seens like a grey area and borders and customs say one thing and the usa embassy say another . The sticking point in the interpretation of "moral tepitude" usa don't consider a dui as moral tepitude so does this mean I can fill in the form as usual? Plus I have not actually been convicted of anything yet . Any help much appreciated

I am not a legal expert in anyway however having done some research as long as you can still answer 'no' to the the question
B) Have you ever been arrested or convicted for an offense or crime involving moral turpitude or a violation related to a controlled substance; or been arrested or convicted for two or more offenses for which the aggregate sentence to confinement was five years or more; or been a controlled substance trafficker; or are you seeking entry to engage in criminal or immoral activities?
on the ESTA you can travel on it.

It seems to suggest drink driving is not a crime of moral turpitude.
 
Personally, I would apply for your ETSA now, answering no. 1. I don't think it is considered moral tepitude and 2. You have no been convicted at this stage. Then you're covered for your trip and for 2 years anyway! :thumbsup2
