DVC Restriction Prediction?

Hello everyone! I hope your day is going well

New DVC member here and wanted to get the Disboard thoughts on something my wife and I have been discussing. Could/would Disney ever enact the restrictions clause on current DVC properties? For example, moving forward if I sold my VGF contract on the resale market place after a specific date, the new buyer could only use it at that resort? Or is this kind of restriction only able to be inserted into new developments?

I really appreciate your opinions and insight.
 
That restriction is part of new associations (resorts). In order to change an existing association, they'd need a super majority of existing members of that association to agree, or they'd face a massive lawsuit involving devaluing the ownership interests of the existing members.

So, if i buy direct at VGF will there be restrictions? ...new tower, not a new property

A contract purchased direct has no restrictions (can book home resort at 11 months, any other resort at 7 months, subject to availability). If you sell your direct contract, the buyer will not be able to use those points at RIV or VDH and probably future resorts.

There are no restrictions of any kind on direct purchases. It's resale purchases that are subject to restrictions.

All original resorts entered BVTC under different terms than RIV and VDH.. which is why they can’t change the rules for those resorts for restrictions, without owner’s approval.
 
DVC could make changes to the BVTC but all changes would apply to all owners. For example, they *could* say that SSR points are worth 0,5 when booking other resorts. But this would apply to direct and resale equally.
They can also remove a resort from the BVTC, but that, I think, only in exceptional circumstances (like a hurricane destroys most of it). And again it would be for everyone.

There are three different reasons that they can remove a resort. One of them is, as you say. It gets damaged and they don’t rebuild..but I’ll have to look up the others.

But, as you said, any change to the rules for trading at the resort apply to all the owners.

They also can make their own charts which don’t have to keep the balances, or charge a fee, or even make different rules for when trading can happen and it doesn’t have to be the same for each resort.

For example, they could say VGF owners can’t trade in or out until 5 months so they h they have a longer home resort period.
 
While this is a long shot at least I would hope they would never do this but your contract only allows you are a room at the resort you own period anything else including trading to a different DVC resort can be changed or removed as above for all owners withing a condo association not just one resort. Keep in mind DVC is just a timeshare in the end. I like to hope it will continue to be as good as it has been over the 20+ years we have owned and it in fact did improve perks since we bought but they were not as good as those offered in the 90's that included park tickets for 50% of the room capacity until 2000
