DVC Management Fee

The property management agreements have a lot of information and I will need to read them a few times to get a good understanding of it all. They are all slightly different with RIV being the most detailed in terms of specifics. Same basic meaning but more detailed,

A few things that stood out from the first read through and of course, created lots of questions I will be asking!

1. DVCMC is considered an independent contractor that each association hires.

2. DVCMC is not responsible for any deficits that occur. My initial interpretation is that if the 12% fee doesn’t cover it, they don’t have to absorb it which could mean a cut in services. It does sound like the company has its own funds above and beyond what each association pays them.

3. They have the right to hire third parties, including agreement with DVD and TWDC to help provide the services they are contracted to perform. I have been told in the past that CMs are employees of Disney and now am wondering if DVCM has indeed contracted with TWDC to staff MS? Is that why we saw furloughs because the employees are not employed by DVCMC directly? Was it out of their control?

4. It mentions that DVCMC can charge the associations additional for special services. Not exactly sure what this refers to so definitely need to get info.

Not buying that it was out of their control. They could have stopped the furloughs if they so chose because DVCMC funding did not change. Someone in DVCMC decided to shut down MS when the resorts closed and allow those CMs to be furloughed. Perhaps that was a good decision. I don't know. But no one should be surprised that they are now having trouble getting all of them back. It's a complicated process for many reasons.

I am much more critical of the recent decisions Disney made to add load to MS by offering things that can only be had by calling, and by the poor membership communication and the abysmal implementation of the changes to the online booking system. JMHO. YMMV.

What I meant was it was a question I would ask to see what answer they give. It just gave me info to frame the questions.

I probably should have phrased better. What I am wondering is if they will ttry to justify it as out of their control because of a third party agreement?

Wanted to share what specific info was tin the document because I will be sending them lots of questions to follow up on the specifics.

So lets say that they are actually going thru Disney for them, which would be absolutely silly and a bit of a pyramid but still we will say that they are. Disney and DVC would have to have a contract to provide those people for the agreed upon terms and since DVC MS is funded from owners there should not have been a sudden cut off, non-payment that would have caused Disney to cancel that contract nor should there have been a request from DVC to cancel the contract.
