Lets assume that in the up coming years Disney will start a DVC II.

Now,in our existing contract, renting our points is allowable. Disney already has our money. They want fresh money from cash paying guests,at the price they deem. If we are renting our points to these potential customers then Disney is loosing that fresh money. We also know Disney monitors this board and probably the renters board. They know what they are loosing.
They can't do anything about our existing contract. BUT....

My question is: When a contract for DVC II is drafted will they eliminate the ability to rent ?

It's unlikely, IMO, unless they also have a provision which prevents a member from allowing a guest to use his villa. The language would have to be very explicit in disallowing such practice. I suspect that there is even some provision in timeshare law which might make that impossible anyway.

I think it'd be tough to prevent someone from renting something which they own the right to use.

I agree with Doc. Legally I can't think of anyway they could prevent renting without making it impossible for them to rent too. I guess they could make it onerous to do so by putting in petty rules but I don't see DVC doing that. Remember that DVD is in the business of selling points and that the renting is a temporary and minor portion of DVC or DVD. Renters are actually a source of fresh meat for them. I've seen a change the last year or so with DVC coming after renters somewhat more aggressively though certainly not to the extent of say Westgate.

Many timeshare offer cheap stays with the condition of forcing a timeshare presentation. DVC usually doesn't do that though VB and HH have dabbled in that arena slightly. I've seen several rent then buy so I don't think they're minding too much.
