Does ROFR affect the seller?

Right now we're in the process of selling points, and we're waiting on Disney's ROFR. The buyers seem like really nice people, and I honestly hope they get it, but I was wondering-are we, as the sellers, affected if Disney exercises their ROFR or will only the potential buyers be impacted? After we get the money from this sale, we'll be the potential buyers, looking for another contract, so I hate to see buyers lose out to Disney's ROFR. But we're on the other side in this one-any impact on us?

No impact on you at all. You get the same amount of money no matter who ends up with the contract - Disney can substitute itself for the buyer if it so chooses, but any and all terms of the contract you negotiated remain exactly the same.

I think you can always go back to the buyer to see if they want to up their offer.

The only affect that I can see is that it supports the market price so the sellers will get more than if DVC did not use ROFR.

Tom from the Timeshare Store posted yesterday that several years ago, this was possible, but that Disney had informed them (the Timeshare Store) that this would no longer be tolerated.

The way the contract is written, DVC can exercise ROFR and close immediately. They allowed new offers as a courtesy but always had the right not to.
