I'm not sure brand confusion would be a problem in Disney's eyes. DTD has Lego and it's not too far away from Legoland. I do think the issue would be money. Would it perform well enough to justify it's creation? Other than movies (John Carter), Disney is pretty good at marketing and creating demand for it's goods. Perhaps a dedicated section of Once Upon A Toy to sort of test the idea to see if it warrants it's own store front. If it makes the $$$, I believed they'd at least consider it.
But you also need to remember that the DTD Lego store has been there for Years, while Legoland just opened within the past year, and is far enough away and still not really known as well as by the General Public.
Disney already gets questions all the time about the Disney Transportation bus they need to take to get to Harry Potter or the Universal park. They also get confused a lot by why they can't use their MYW ticket to see Harry Potter. It's just like with all the hype about CarsLand you know they are starting to ask CM's in Florida how to get to it. Sometimes it's VERY easy for those of us on the DIS to forget that there are a lot of visitors to WDW who just don't realize that Universal and Disney are not the same or affiliated in any way, and don't really do much research into what exactly they are getting themselves into.
As such, there is a very real possibility that if they increased the Marvel presence within the WDW compound with a branded retail shop at DTD, You will start to increase the confusion on why they don't have a ride, or a chance to get a photo with Spiderman or Captain America.... or with the Universal billboards which have Spiderman on them, people asking which park has the Spiderman ride. It'll also likely just increase the misinformation out there from CM's and Bus Drivers on the details of he Universal Contract and when it's expiring so Disney can build it's ride. (Especially when they complete or officially announce the Avengers attractions in California and other worldwide parks which were mentioned in the article that started this thread)
