Delayed closing now what to do

The biggest problem would be getting something for this November. That would not be easy this late in the year. Even with a closing scheduled in Sept.

I'm not sure what TTS (or any reseller) is supposed to do about a seller who can't or won't execute the documents...

I agree assuming the broker was unaware. If they were aware and didn't disclose it, that'd be a major issue in my book. Just knowing they were out of the country, the should have both addressed the issues ahead of time and disclosed that item and the possible issues to the buyer. The only way the broker comes out as being reasonable is if they didn't know the seller was from out of the US or if they disclosed the known possible issues.

Really, it's quite indefensible that you have been left hanging in the dark like this, but it happens with regularity with TTS and their closing unit.

I was referring not to the seller, but rather to the lack of information that was given to the OP regarding the month long delay. OP had to ferret this information out nearly 2 weeks after passing rofr.

The issue is the sellers paper work has to be notarized in english.

So have them go to the US embassy.

Signed the contract 7/27/2011.
Sent in to Disney 8/3/2011.
Passed ROFR 8/15/2011.
Contacted title company 8/24/2011 to see what's the hold up, was told they were still waiting on documents from TTS.
Contacted TTS 8/26/2011 to see what's going on, we were informed that the sellers are in Taiwan and will not be back till 9/26/2011.
The contract says to close by 9/21/2011 so they will not even be back by the close date. TTS wanted to know if it was ok with us to close later.

For all we know, the sellers had an emergency that called them out of town (death in the family; family emergency, etc.). In that event, it would be unlikely that they would get a notary there.

If it was a pre-planned vacation, that's what a power of attorney is for.
