If you have a loan I don't think you can change the registration because you'd have to have the loan company agree to it. I do not ever recall anyone saying they could but also don't recall anyone saying they tried and failed. I wouldn't mess with it if there's a loan.
Actually it's very simple to do and not nearly as risky or difficult as some would like you to believe even if buying or selling. Here's how you'd do it.
Contact DVC for their current info. What follows is the correct info as of winter 2007, I see no indications the process has changed except that Orange County has done away with the form DR219
- Complete and send in the "Request to Transfer Form" documenting the legal description, who the current owners are and who the new owners will be. Basically you list the current owners and any then ALL owners on the transfer to line including any current owners. This form is designed to transfer when there is no payment being received. The process is similar if a sales but instead of this form, you'd send them the contract and request for ROFR specifying a closing date at least 30 days from when they are to receive it.
- They will send you the ROFR form based on this info.
- Then you just need to send the ROFR form and quit claim deed with the proper recording fees to Orange County.
- Once you have the recorded deed back, you then send a COPY to DVC along with the completed transfer form.
A few tidbits:
One can put multiple requests on the same forms AND one can ask DVC to put multiple contracts on ONE ROFR letter. They MAY balk and require them to be separate if they are different home resorts or master contracts but no harm in trying as you have to pay by the page and document for recording.
You can print the recorded copy off the website so no need to wait for it to return by mail, this can save you some time.
Have the quit claim (or any other type) ready when you get the paperwork so you can send it on.
Unlike a sale, you do need a copy of the recorded deed per the info I received at the time.
Orange County recording requirements
List of fees A 2 page deed and a 2 page ROFR would be $37 as I understand it assuming 4 names or less. It's $10 for page 1 and $8.50 for each subsequent page but because the deed and ROFR are technically separate docs, you pay $10 for each first page. I wonder out load what would happen if you got ROFR but didn't record it at the time. I'm guessing DVC would still record the deed if the ROFR had been issued even if not recorded.
