Buying resale and Paying Dues

I am currently a DVC member and bought resale before, but I have a question. With it being near time to pay annual dues, if I buy a contract and we don't close until after the annual dues due date how do I know for sure they were paid be the previous owner (for instance if I paid the dues in my contract agreement with the seller but then the seller doesn't apply the payment to their contract). Before we can close will Disney make them pay the dues for the closing to finish if they haven't? I don't want to pay the dues, then end up getting the contract and dues be due again if that is possible. It may not even be possible, and I am making it more complicated than it has to be.

I bought in the middle of the year last time, so I didn't have to think about this.

Thanks!

You agree to who pays dues in your contract. You do not have to worry if the seller has paid dues or not, more than likely you as the buyer are paying for 2016 dues. If a seller was behind, Disney would make sure the seller has paid up prior to close.

I believe that if you are asked to pay the dues as part of the contract then the closing agent will handle the payment. The funds would not be given to the seller as they don't get the funds until after closing.

This is correct. The seller would never be given the money for the 2016 dues if they agreed to pay them in the contract. The closing company would pay the 2016 dues to Disney on the seller's behalf.

If the money for dues is included in your resale the closing agent would then pay them to Disney. If you look at most contracts listed recently a lot of them asking for 2016 dues plus closing costs.
