We have a blue card with 75 points purchased direct in 2019, we’ve since added on twice resale and are looking to add on again with 100-150 more. If we elected to add on 150 direct (current min for blue card benefits) how would that work later in life if we wanted to pass the contracts on to our two girls? If we made sure one got the 75 point contract and the other the 150 point contract would they both get blue cards if they were both in the same membership? How about with different UY?

It’s not a huge factor in our decisions going forward, but RIV with current incentives is similar in price to BLT, PVB, etc. at current resale prices, add to it skipping ROFR, 2021 points with less dues, and slightly lower closing costs, getting both girls blue cards is just another weight on the scale for direct.

Related question, are RIV and AUL the only ones currently getting incentives? With ROFR back at full force it seems they are building sold out resort inventory, wasn’t sure if they offer unadvertised incentives to other resorts.

You're currently qualified for a blue card, and any gratuitous transfer would retain that benefit. If you're going to split your contracts between your two children, then they'd each need qualifying points.
 
You are correct that if you did a gratuitous transfer to your daughters one would need the qualified 75 points and the other the possible 150 point direct contract to have a blue card. The benefits stay with the contract when doing a gratuitous transfer. Once it’s sold resale however it loses all its blue card status. The UY or numbers of contracts in a membership doesn’t matter, how they were purchased does.

To give the contracts to the girls and keep in the same membership, you’d have to title each of the them with both.

Once you transfer one contract to one and one to the other, each becomes a brand new membership since each is a different owner,

We have adult 3 kids and added them to our Aug UY contracts so all are owners now, As we pass, the title just stays with them as a joint membership.

Our Dec UY is still just us but at some point, they will all be added, We discussed it with them and decided they would continue to be joint owners vs, individual ones.
 

In the past, Disney has grandfathered gratuitous transfers. That doesn't mean they have to in the future, or that there even will be a Blue Card in the future.

If I were going to do this, I'd talk to a local estate attorney. People frequently use trusts and companies to accomplish this and to avoid FL probate. With this much money in DVC, maybe it's worth getting real legal advice and doing this right.
 
How old are your girls? My son is 27 and we just asked him if he wanted one of our smaller contracts. We told him he would be responsible for the dues. He said not at this time because he can't afford the dues, the travel to WDW and the park admission. If your girls are young, they might not be able to afford those contracts either when you want to gift them to them.
 
Thanks for all the info and advice. I agree relying on the contracts to transfer in the future based on the rules today is a gamble at best, given their propensity to change the rules. I tend to agree that adding them to the deed on the new one, since it would likely be in a different UY anyway, would be a good start, then we can see about adding them to the deeds on all the others in our original FEB UY.

I’ve always been reluctant to consider adding a new UY, although we did originally commit to 2 100 point RIV contracts in 2019, instead of 1 200 point contract, for this very reason of passing them on to our girls. In the end, we backed out of those contracts in the 10 day rescission period, we decided to buy a new house and didn’t want that purchase to muddy the waters while trying to get a new mortgage.

We were also going to add a new UY back then, mostly because when RIV sales started they wouldn’t give FEB UY the loaded points like all the other UY’s were given. But since these new points will most likely always be used in alternating September trips, every other year, opposite years from our PVB points. Having a SEP UY makes a lot more sense in that case, despite what trouble having 2 UY might present. Oddly enough, in 2019 we had to get “approval” to buy a different UY, is that normal or was that guide games?

Thanks again, and a thumbs up to RoseGold, seeking legal advice is probably a good idea. I just assumed many people have been down this road before us, and might have found the answer to those questions.

I’m 47, my wife is 38, and our girls are still very young, 9 and 4. It isn’t a guarantee that they would want and/or be able to afford it. And we wouldn’t mind paying for as long as we are around, as long as mom and dad are cool enough to vacation with, and if not we will sell them. But we’d like to plan ahead and have the option to pass them on to them if they do want them.

We just bought Riv about two weeks ago. They were initially pushing the Dec UY but we said we needed Sep. My guide asked why and then told us he had to get approval. It took all of a min or so to get that approval though.

Disney has 4,000,000+ unsold points left to unload at Riviera. They may be trying to load balance all UYs for future sales, but it's hard to imagine there being a shortage of any UY at this point. Glad you pushed back and didn't get settle into a non optimal UY that you need to live with for potentially the next 49 years...

I was surprised there was some pushback for that reason but thankfully it was minimal! We wouldn't have bought if they stood firm on the Dec UY since it does not work for us.

He wouldn't even ask for the exception just said nope. I told him to let me know when December was available and we would buy. He got a little uptight at that point, telling me it may not be available buy then and who knows what the price would be. I am thinking I may call back and talk to someone different to see if I get the right guide who needs the sale.

Definitely call back. There is no reason with RIV you can’t get the UY you want. A sold out resort is different but for the one in active sales is never a problem getting points in the UY that fits your needs.

We bought over the phone and when I was coaching my husband on what to say I had mentioned that they would push a Dec UY but we wanted Sep because I had read somewhere else that someone who recently bought was pushed Dec so it wasn't just me. I am really surprised they gave you a hard time. I agree with Sandisw, definitely call back.

I've been reviewing these boards and multiple posts on this matter. It sounds like there is internal DVC messaging that is preventing guides from selling UYs that are beyond the bankable period. So, right now (July 2021) it would be August, Sept, and October. I'm hoping that so long as a prospective member is firm that DVC will grant these UYs and bank the points.

I understand all the reasons behind this standpoint of DVC (the glut of points in the system due to COVID, lack of availability right now, etc.), but when a person is buying a direct real estate interest for 20-50 years they should get exactly the UY they want. This is a huge luxury purchase for many families. I feel like Disney already relies on new members being uninformed about UY. (I mean, their own website has no UY information just a blanket statement.) And it's a disservice to advise new members to wait or choose a UY that will adversely impact their vacation plans in the long run.

I am speaking to my own guide later today, as we want a September UY and it is very disheartening that this might not be possible, which means we would miss out on RIV incentives. I feel like I spent a lot of time and energy researching to make this decision and it may have been time wasted. We shall see!

If you are adamant to get a Sept UY, and they are adamant to not give you 2020 points, ask them to honor the incentive price until sept 1st. I don’t think that’s an unreasonable solution. I know you likely want the 2020 points, and I would keep asking for that, I’m just suggesting this as a last resort.
 
They were giving me some flack about use years with my purchase last month.

I ended up securing 2 fixed weeks in an for week 43 which falls around Halloween. Once the fixed weeks were locked in they had no problem changing the UY to Oct and letting me bank the 2020 points.

Fixed week may be an option worth pursuing…

Thanks for the suggestion! However, we are splitting our purchase into 2 separate contracts (150 & 50), so I don’t think that’s going to work for us.

I appreciate the insight though!

We must be on the same wavelength, as my husband and I talked about this as the last option until we walk away and just go resale. It’s not about 2020 points, it’s about these 2 elements: 1) RIV incentives that expire 8/4 and 2) September UY.
