I've only bought/sold on Ebay but recently purchased a book on Half.com. It was listed as "brand new". The book came and it is obvious it isn't new. The white cover has scuff marks and crayon or colored pencil marks and the cover itself is used - ie when you lay flat on the table the front cover flips up on it's own. Also, inside the pages are dogeared as well as a few are written on.

This would not be a problem had the seller listed as a used book right?

I have contacted the seller the day I rec'd it....Friday but have yet to hear anything back. I realize it was a holiday weekend. This seller has 100% feedback so I am not sure what to think.

What do you think a resonable resolution would be and how long do I wait to hear from the seller before filing a claim?

I've ordered from half.com many times and have never had a problem. I read the description very carefully to make sure it says "new", etc. I also check feedback. Sounds like you did your due diligence. I think you're right to contact the seller and ask they do an adjustment of some sort. If they refuse, make sure to document what happened in the feedback section.

Good luck,

I have sold over 750 books at half.com and have purchased there too, so I know the system pretty well. I

f a book is listed as new it has to be in new condition. Clearly the book you received is not. I'd ask for a complete refund plus shipping both ways. If the book was inexpensive, the seller is likely to tell you to just keep the book and he/she will refund you the purchase price and you still paid for the shipping one way to you.

They will do this because their options are not good. If you dispute that the book arrived as described they can expect negative feedback from you. These days some people, in an effort to get their book to appear at the top of the screen, are listing books as "new" or "like new" when they don't match that category, as defined by half.com (My favorite is a "new" book with underlining). The penalty for listing a book without complying with half.com's descriptions is banishment from the site, regardless of whether or not the lister ever read the half.com policy.

Unlike ebay you aren't in a huge rush to get this worked through. So, definitely try to work it out with the seller to a place where you are both satisfied. Maybe you could look on the site and decide that a fairer price would have been what a book in "acceptable" condition would sell for. If you bought new because you intended to give it as a gift, the book is of zero value to you, but otherwise, you maybe can negotiate a price that will salvage the sale for the seller and still make you feel like you didn't get taken.

thanks for the replies....but...
how long should I wait? I have emailed several times since Friday and had NO response. The seller currently has another book (different one) listed. Problem is I need to use this book for a class but I have been hesitant to use it myself until a resolution.....any suggestions?

One more note, the seller may have had more than one of the same title, and inadvertently mailed the wrong one to you. I know, this happened to me, I had two books with the same title, I mailed the wrong one to a buyer, and rather than contacting me, he just decided to give me my FIRST negative rating, while I was over 1600 Positives at 100%
I would e-mail the seller and give them at least 1-week to reply.

Well tomorrow is a week from when I rec'd the book although I bought and paid on May 15th. The seller didn't mail until 5/23 also an issue as they told me a different mail date.
