I put myself through college working in restaurants in Gainesville, FL (University of Florida) Back then you can take an unfinished open bottle of wine out of restaurant under certain conditions. A couple of years ago I was in St Pete for an Indycar race. The restaurant had an amazing "happy hour" deal on bottles of wine. The server suggested I order the bottle have a couple glasses and then take the bottle back to my hotel room. I did this. I just checked and the regulations have remained the same. While not applicable to open cups of alchol might be something to keep in mind...

Section 564.09 of the Florida statutes provides that a restaurant licensed to sell wine may permit a patron to remove one unsealed bottle of wine if (i) the patron consumed a portion of the wine with the purchase of a full meal, (ii) the restaurant securely reseals the bottle, (iii) the bottle is placed in a bag that is secured in a manner that is visibly apparent if the bag has been opened and (iv) a dated receipt for the wine and meal is available.
