Just heard our resale seller decided not to sell a week after our offer was accepted. :sad1: I have been a dvc dis board reader for a year, a disney lover since childhood and finally took the plunge on a resale to become a dvc member. DH took a little bit of convincing given the economy so I'm sad to tell him it's fallen through.
Interestingly it looks like our contract is listed on another resale website as pending - do sellers list with multiple resale companies (and would it say pending because it was with me) or did they hop from one company to the other?
I guess it doesn't change the outcome. Might make me buy direct from Disney, however, just to avoid some more potential heartbreak...

Depending on what you mean by your offer was accepted, you may have a legal claim here. If you have a signed acceptance to your offer then a contract has been struck. Of course, it may not be worth the effort (and money) to pursue the issue - lawyer fees add up quickly.
 
I am so sorry for you Anna08. I am sure that you are crushed. Just remember everything happens for a reason, so there must be a better contract out there for you!pixiedust:
 
Sorry about that. We went thru ROFR, and Disney picked up the contract, so we are trying again, and waiting to hear about ROFR. I noticed last night that there are a LOT of new resales. If you haven't yet, check the Timeshare Store. They are helpful and there sure looks like a lot for sale! You will find the right one...just try again!
 

I would see it as a positive. Better now that a week before close. It seems as though re-sale prices are prime to drop in the next 6-months, so it might be a blessing there too.
Sorry to hear about your luck. I just closed today on 100pts at OKW... i kind of wished i would have waited 6-months.
 
We were ROFR'd on 2 resale contracts and felt exactly as you do now. However, as it turned out, I got to buy BLT (my DREAM) last month, direct from Disney with unbelievable incentives I could not have received any other time.

Keep your chin up, this was simply not meant to be yours, the right one will come!:thumbsup2

I think I understand your thought on this, but wouldn't ya figure if prices fall that much Disney will only use their ROFR more 'n buy it out from under ya?

I'm really sorry! But...don't give up. :goodvibes We made offers on a couple of contracts that were not accepted. However, once accepted, all went through with ease.

There are so many sellers out there, especially in the last few months. Try checking out some of the major resale brokers, and I'm sure you'll find an even better contract than the one you lost. With maintenance fees due right around the corner (January), you'll see some motivated sellers, which is GREAT news for you! :thumbsup2

Most brokers that specialize in DVC list contracts nonexclusively. That means you could list with several if you wanted, or more likely, list with someone and try to sell it on your own. They have an obligation to let the other listers know within a certain period of time if the listing is no longer available. Until you get something done in writing, you really wouldn't have any case against a seller unless possibly you offered the asking price which the seller might have committed to up front depending on their contract with the broker. OTOH, the broker might have more of a case for their commission if and only if the seller didn't let them know within a reasonable period of time. But I think it happens where there were communication delays such as the seller did let the listing company know but not everyone got the message and it hadn't yet been taken down from listing as available.

The specifics in this case could be interesting but we don't really know them yet.
