Of course the baby is non-viable even discounting the latest report of severe deformities he/she has not even reached the viability threshold. Frankly, I don't think viability should really matter one way or another in the case of keeping a dead body going against the wishes of the deceased and her family.

Apparently the hospital isn't alone, as the Tarrant County DA is defending the hospital in court. So I suppose "the state" is actually acting as if the hospital is following state law, although I'm thinking the decision could be different in another county or if the Texas Attorney General took over.
I hope they don't put this family through anymore heartache by appealing. If the hospital has been ordered by the court to take her off life support, then just DO IT. What's to appeal? These cases are maddening.

Their defense was handled by the Tarrant County DA's office. If they have an ideological bent, they might very well go ahead with an appeal even if the hospital doesn't wish it. Maybe they don't get the hospital to go along willingly, but I could see them looking at getting a temporary restraining order against the hospital.
It's all wacko how the hospital was able to get support from the DA's office.
