According to a report I read Mr. Munoz said that a doctor did declare her dead, but the hospital maintains that she is merely in "serious condition".

My guess is that will be the result of today's hearing.Then maybe it is time for an independent medical professional or 2 to come in and decide which she is. Since the hospital isn't going to change their minds and declare her dead since then they would look stupid for keeping this up for so long.
How does the hospital have a leg to stand on if Marlise has been declared brain dead?Court documents included statements from the hospital that not only showed the mother had in fact been declared brain dead but also said that the fetus is non-viable. Of course the baby is non-viable even discounting the latest report of severe deformities he/she has not even reached the viability threshold. Frankly, I don't think viability should really matter one way or another in the case of keeping a dead body going against the wishes of the deceased and her family.
Why does the hospital get to have until Monday to take her off?
I've been following similar cases. Often they'll give enough time for one of the parties to appeal to a higher court.

The hospital has insulated itself from any liability, now they can say they took her off the vent because the court directed them to do so.
The hospital is expected to issue a statement shortly.
I hope they don't put this family through anymore heartache by appealing. If the hospital has been ordered by the court to take her off life support, then just DO IT. What's to appeal? These cases are maddening.
